The details regarding offenders under the age of 18 in the 11th Judicial Package, which is expected to be presented to the Parliament soon, have drawn attention. The package proposes the establishment of a commission for offenders under the age of 18, while it is anticipated that the penalties for gangs will be doubled with this regulation.

The 11th Judicial Package includes a detail that closely concerns offenders under the age of 18. According to the regulation in the package, a commission will be established for children under 18. Additionally, the penalties for gangs will be doubled.



MINISTER TUNÇ: INCREASING PENALTIES FOR THOSE WHO USE CHILDREN AS TOOLS



On the other hand, Justice Minister Yılmaz Tunç recently made statements regarding the 11th Judicial Package. Minister Tunç emphasized that regulations concerning criminal organizations will be included in Article 220 of the Turkish Penal Code, stating, "Our members of parliament have not yet turned this into a proposal. It will be in the 11th Judicial Package. It is a matter of increasing penalties for those who lead children to crime and use children as tools in crime."



PENALTY FOR ESTABLISHING AND MANAGING AN ORGANIZATION WILL BE INCREASED UP TO 10 YEARS



Regarding the legislative proposal, Tunç stated that it is foreseen to increase the lower and upper limits of prison sentences for the crimes of establishing, managing, and being a member of an organization. He provided the following information: "Accordingly, the penalty for the crime of establishing and managing an organization will be increased from 4 years to a maximum of 10 years in prison, while the upper limit for the crime of being a member of an organization will be set at 5 years in prison, up from 4 years."



Furthermore, if the organization is armed, the increase in the penalty will be regulated to be only half of the quarter increase. Accordingly, a person managing an armed organization will face a prison sentence of 5 to 12 years, while according to the proposal, the sentence could be increased to 7 years and 6 months to 15 years.



On the other hand, it is accepted that in crimes committed within the framework of the organization's activities, if children are used as tools, the penalty for the organization leaders will be increased by up to one and a half times. For example, if an organization leader uses a child to threaten someone, or to shoot someone with a weapon, the penalty for the crime of leadership could be increased by one and a half times. Accordingly, if the lower limit of the prison sentence of 7 years and 6 months is increased by 1/2, it will become 11 years and 3 months; if the upper limit of the prison sentence of 15 years is increased by one time, it could become 30 years. Currently, there was no crime defined as using a child as a tool.
