After the statement process in İzmir, police officer Süleyman Ay, who is accused of sexually assaulting Büşra Karademir after dropping her off at her home, was sentenced to 10 years and 6 months in prison without any reductions for the crimes of 'sexual assault' and 'violation of the inviolability of the home.' Büşra Karademir, who injured Ay with a gun during the incident, was acquitted.
On January 31, 2024, around 11:00 PM, an incident occurred in an apartment in the TOKİ Housing Complex on 6002 Street in the Uzundere neighborhood of the Karabağlar district of İzmir. Büşra Karademir, who has four children from her first marriage and is experiencing severe marital discord with her second husband, Cenk Karademir, for whom a divorce case will be heard on February 2, allegedly pressed the 'KADES' application to request help when her husband came to the house. Police teams arrived at the scene shortly and took Büşra Karademir to the Family Violence Bureau of the Karabağlar District Police Department.
ENTERED THE HOUSE SAYING "LET ME CHECK THE DOOR"
As part of the investigation, Büşra Karademir recounted the events in her statement. According to Karademir's claim, police officer Süleyman Ay gave her candy, saying, "Such beautiful women don't come here," and then touched her cheek. After the statement process was completed, Karademir got into the police vehicle. She was taken home by Ay and another officer, Ş.M., who was driving. After getting out of the vehicle, Ay entered Karademir's house, saying, "Let me check the door."
COMMITTED SEXUAL ASSAULT
According to the allegations, police officer Ay took off his gun and jacket and left them in front of the mirror in the house, cornered Karademir, and sexually assaulted her. Karademir tried to fend him off and fired the gun she grabbed from the mirror. Officer Ay was injured in the abdomen. Karademir, who went out to the balcony, shouted for help, saying, "The police attacked me. Help. I shot the police." Officer Ay was taken to Dokuz Eylul University Hospital by ambulance and was discharged after treatment. After the incident, Büşra Karademir was arrested at the courthouse she was sent to. Officer Ay was suspended. Büşra Karademir was later released to be tried without detention.
INDICTMENT ACCEPTED
After the investigation was completed, the prepared indictment stated that Süleyman Ay was charged with 'Qualifying violation of the residence immunity' for 1 to 3 years, 'Depriving a person of their freedom for sexual purposes using force, threat, or deception' for 3 to 10.5 years, 'Attempted qualified sexual assault' for 7.5 to 15 years, 'Repeated sexual harassment' for 6 months to 3 years, and 'Sexual assault by harassment' for 2 to 5 years, totaling a request for imprisonment of 14 to 36.5 years. The indictment was accepted by the İzmir 1st Heavy Penal Court. In the last hearing, the prosecution presented its opinion on the merits. In the opinion, it was requested that Karademir be acquitted as she committed this crime to prevent harassment, while it was requested that Süleyman Ay be punished for violating residence immunity and for sexual behaviors that amounted to harassment.
"I AM THE VICTIM"
The trial of the defendants continued today at the İzmir 1st Heavy Penal Court. The hearing was attended by the complainants, defendants, and their lawyers. In response to the opinion on the merits, Karademir's lawyer, Şule Ak, stated that they agreed with the opinion. Ay's lawyer, Emrullah Aksakal, requested his client's acquittal. During the hearing, Büşra Karademir stated that she wanted the heaviest punishment for Süleyman Ay. Süleyman Ay also said, "He had difficulty opening the door while leaving me at home. He said, 'There is a problem behind the door, can you check?' At that moment, since my life was under my responsibility, I entered with my shoe with his consent. Then I was attacked. My health is gone. I am the victim."
DECISION IN THE CASE
After the defenses, the decision was announced. The defendant Ay was sentenced to 6 years in prison for 'sexual assault,' and due to being a public official, his sentence was increased to 9 years. Süleyman Ay was also sentenced to 1 year and 6 months in prison for 'violating residence immunity,' resulting in a total sentence of 10 years and 6 months without any reductions. The court ruled that Büşra Karademir committed the alleged crimes to escape the attack against her and decided on her acquittal.
