AN INVESTIGATION HAS BEEN INITIATED
In the indictment prepared by the Anadolu Chief Public Prosecutor's Office Special Investigation Bureau, an investigation was initiated based on the allegation that between 2019 and 2021, 44 properties belonging to the municipality were rented out in violation of the provisions of Article 51 of the Public Procurement Law, and that the suspects misused their duties.
ILLEGALITY IN THE RENTAL OF PROPERTIES HAS BEEN DETECTED
The indictment also included the inspection conducted by the Ministry of Interior. It was stated in the indictment that all transactions related to the rental of properties belonging to Kartal Municipality were conducted in violation of the law. It was noted that all 44 tenders took place in an environment devoid of competition with a single participant, and that the contractors were granted the right to be tenants with very minimal increases in shares in a non-competitive environment, which led to potential damages by preventing the properties from being tendered at higher rental prices on behalf of the administration, and sufficient evidence was obtained that would necessitate the opening of a public case against the suspects.

In the indictment, it was reported that the suspects, whose defenses were taken regarding the mentioned actions, requested a decision of non-prosecution by denying the accusations; however, it was stated that the defenses, which were deemed contradictory to the existing evidence and aimed at escaping the crime, were not taken into account. It was noted in the indictment that the suspect, Mayor Gökhan Yüksel, approved many tender approval documents as 'superior authority' and thus caused the tender to be conducted through negotiation methods in violation of the law. It was emphasized that all tenders took place in an environment devoid of competition with a single participant.
PENALTY REQUESTS
It was requested that 19 suspects, including Gökhan Yüksel, be sentenced to imprisonment from 10 months to 3 years and 6 months for the crime of 'misuse of office in a chain manner.' For 2 suspects, it was requested that they be sentenced to imprisonment from 6 months to 2 years for the crime of 'misuse of office.'
