THE VICTIM CHILD'S TESTIMONY WAS HAUNTING
The victim, D.A., recounted in her statement that the defendant had caught her alone many times, had physical contact behind closed doors, and had frightened her with threatening words. The little girl said in her statement, "He turned off the light in the bathroom, then turned it on again. He came over me. I was very scared, but I couldn't tell anyone."
"SERIAL CRIME" ASSESSMENT WAS MADE
According to a report in Sabah, it was clearly stated in the reasoned decision that the defendant repeated the same behaviors, that the abuse was continuous, and that he systematically violated the child's physical boundaries. The court assessed that the incidents were not just a one-time occurrence, based on the child's statements and testimonies, and made a "serial crime" evaluation.
"I WILL TELL YOU SOMETHING BUT DON'T TELL ANYONE"
The events experienced by D.A. were learned by her mother, T.E., through a therapy process. The little girl approached her mother saying, "I will tell you something but don't tell anyone," revealing what had happened behind the scenes of the serial abuse. The psychologist's report indicated that the child's narratives were free from manipulation and sincerely conveyed the emotional impact of the events.
In the court decision, it was emphasized that D.A.'s statements were age-appropriate, followed a logical flow, and were consistent. The reasoned decision included the following statements:
"THE CHILD'S NARRATIVE IS NOT MEMORIZED, IT'S REAL"
"The victim's statements are consistent with the reality in terms of the sequence of events, details, and emotional expression. There is no impression of being memorized or directed. The defendant's defense, on the other hand, is contradictory and far from being convincing."
10 YEARS IN PRISON FOR THE DEFENDANT
At the end of the trial, the defendant, who received a total of 10 years in prison, was not granted any reduction or postponement. The court also ruled for the continuation of the defendant's detention.
