Constitutional Court's Decision on Can Atalay: Dismissal of Parliamentary Membership is Null and Void.

The Constitutional Court has decided that the dismissal of Can Atalay's parliamentary membership, who was sentenced to 18 years in prison in the Gezi Park case, is null and void.

The Constitutional Court (CC), with its reasoned decision regarding Can Atalay, who was elected as a Member of Parliament from the TİP party in Hatay, determined that the dismissal of his parliamentary membership was null and void. Atalay's membership was revoked in January.

WHAT HAPPENED?

Istanbul 13th Heavy Penal Court sentenced Atalay to 18 years in prison for "attempting to overthrow the Government of the Republic of Turkey" and ordered his arrest. Istanbul Regional Court of Justice found the local court's decision to be lawful. Can Atalay, who was elected as a Member of Parliament from the TİP party in the 28th Parliamentary General Election, appealed to the Court of Cassation, and while the process was ongoing, the 3rd Criminal Chamber of the Court of Cassation upheld the 18-year prison sentence given to Can Atalay in the Gezi Park trial.

After the Court of Cassation's rejection, Atalay applied to the Constitutional Court twice, and in both applications, the Constitutional Court ruled that there was a violation of rights. The 3rd Criminal Chamber of the Court of Cassation ruled that there was no place to comply with the Constitutional Court's decisions regarding Atalay's rights violation and ordered the decision to be sent to the Presidency of the Grand National Assembly. Meanwhile, with the revocation of Can Atalay's parliamentary membership, the TİP party's number of seats in the Parliament decreased from 4 to 3.
