Details of the maternity leave rights granted to civil servants! Will there be a salary deduction?

The regulation granting public servants the right to work part-time has been published in the Official Gazette. According to the regulation, civil servants can work part-time from the end of maternity or paternity leave until the beginning of the month following the date when their child reaches primary school age. During this period, civil servants will be able to receive half of their salaries and payments.

Following the announcement by President Recep Tayyip Erdoğan regarding maternity leave for civil servants after the Cabinet Meeting, the details of the implementation have been clarified with the published regulation. There will be no distinction between female and male civil servants in the use of part-time work rights. If both spouses are civil servants, both can benefit from the part-time work right upon their requests.



According to the regulation, all female and male civil servants subject to the Law No. 657 on State Civil Servants can benefit from part-time work opportunities until their children start primary education, starting from the birth of their children. Female civil servants who give birth can apply to benefit from this right after their maternity or unpaid leave, and male civil servants whose spouses give birth can also apply after their paternity leave.



NO DISTINCTION BETWEEN WOMEN AND MEN



There will be no distinction between female and male civil servants in the use of part-time work rights. If both spouses are civil servants, both can benefit from the part-time work right based on their requests. Civil servants can request part-time work from their institution at any time during the part-time work period.



SAME RIGHTS GRANTED TO ADOPTIVE PARENTS



The regulation grants the same rights to adoptive parents as well as to those who give birth. Civil servants can benefit from this right from the date the child is actually adopted or from the end of legal leave until the child starts primary education.



DIRECTORS AND HIGHER POSITIONS CANNOT BENEFIT



Civil servants working in positions with titles of branch manager and above in public institutions and organizations, as well as those working in overseas organizations, will not be able to benefit from the part-time work right.



INITIAL STAGE EXPECTS 20,000-30,000 CIVIL SERVANTS TO BENEFIT



On the other hand, according to information obtained from the Ministry of Family and Social Services, with the new regulation, the scope of the right, which previously benefited about 1,000 civil servants, has been expanded. In this context, it is expected that initially 20,000-30,000 civil servants will benefit from the part-time work opportunity granted until their children start primary education.



WHAT WILL THE WORKING CONDITIONS BE?



The weekly working hours of the civil servant will be arranged as half of the normal weekly working hours. The weekly working days cannot be less than 3. The daily working hours of the civil servant can be determined differently according to the days, or the daily working time can be arranged equally. Civil servants can use their leave of absence and annual leave for the periods specified in the Law No. 657, excluding milk leave. Additionally, female civil servants will not be granted milk leave. The authorized supervisor can change the days and hours of part-time work twice a year in January and July, depending on the service needs or the request of the civil servant.



CALCULATED SEPARATELY FOR EACH CHILD



Except for unpaid leave, the periods spent on annual leave, sick leave, or other leaves during the part-time work period, as well as the national holidays and general holiday days during the part-time work period, will be considered as part-time work. The duration of the part-time work right will be calculated separately for each child. The part-time work right will end when the child starts primary school.



If the birth or adoption occurs before the appointment to the civil service, the civil servant can benefit from this right upon request during the part-time work period, provided they start their duty.



THEY WILL BE ABLE TO RECEIVE HALF OF THEIR SALARIES AND PAYMENTS



The weekly working hours of the civil servant benefiting from this right will be arranged as half of the normal weekly working hours.



The weekly working hours of the civil servant benefiting from part-time work will not exceed 3 days, and they cannot work less than 3 hours or more than 8 hours daily. Civil servants will be able to receive half of their salaries and payments during this period.



Civil servants benefiting from the regulation will not be able to work outside of working hours and during lunch breaks. Working hours may vary on different days. The authorized supervisor in the institution can make changes to working hours in January and July. Additionally, female civil servants working part-time will not be granted milk leave.



The part-time working principles for civil servants working in services that operate continuously 24 hours a day will be determined by the institution based on the service needs, considering half of the normal weekly working hours.



The part-time work right will end in the event of the civil servant losing their child, the termination of the adoption relationship, the child starting primary school, or a request to return to normal work.
