A doctor, S.F.H., working at a private hospital in the Polatlı district of Ankara, was sentenced to 2.5 years in prison for the crime of 'sexual assault by harassment' against his medical secretary, S.Y., in a trial where he was not detained. The indictment stated that the doctor kissed his medical secretary on the cheek and then hugged and touched her when there were no patients in the clinic room.
S.Y., who works as a medical secretary at a private hospital in Polatlı, filed a criminal complaint alleging that Ear, Nose, and Throat Specialist Dr. S.F.H. verbally and physically sexually assaulted her.
Dr. S.F.H., who was detained as part of the investigation, was released under judicial control by the duty magistrate to whom he was referred with a request for arrest. At the end of the investigation, an indictment was prepared against S.F.H. for the crime of 'sexual assault by harassment,' with a request for up to 5 years in prison, and a lawsuit was filed.
KISSED HER CHEEK AND TOUCHED HER
The indictment stated that Dr. S.F.H. kissed the cheek of medical secretary S.Y. and then hugged and touched her when there were no patients in the clinic room.
DOCTOR CLAIMED THE ALLEGATIONS WERE BASELESS
During the verdict hearing of the case held at the Polatlı Criminal Court of First Instance, the victim and the defendant, along with their lawyers, were present. The lawyer of the plaintiff S.Y. stated that the defendant committed the crime charged against him and requested punishment at the upper limit. The defendant, on the other hand, claimed that the allegations were baseless and requested his acquittal.
HE WAS SENTENCED TO 2.5 YEARS IN PRISON
The judge, believing that the defendant committed the crime charged against him by abusing the influence provided by the employment relationship, sentenced him to 2.5 years in prison for the crime of 'sexual assault by harassment,' with a reduction in the sentence.
