A 42-year-old man, M.T., who has been charged with sexual assault against his 19-year-old relative with a 70% mental disability, appeared before the judge. On December 5, 2024, in the Baklalı neighborhood of the Sarıçam district, it was alleged that G.G.S. (19), who has a mental disability, was called to the olive grove by her relative M.T. (42) while putting the sheep in the barn. M.T. told the young girl to take off her clothes, and when she refused, he threatened, "I will kill you here." DENIED THE RAPE ALLEGATION
Following the mother's complaint, M.T. was arrested and a case was opened against him at the Adana 7th High Criminal Court for 'qualified sexual assault against a person unable to defend themselves.' The hearing was attended by the detained defendant M.T., the complainants, their lawyers, and a lawyer from the Adana Family and Social Services Directorate. M.T., a married father of two who works in animal husbandry, denied the allegations.
M.T. claimed that when he went to his father-in-law's house, G.G.S. and his father-in-law were there, stating, "I sat with them for about 3 minutes. Then the vegetable seller came. G.G.S. and my father-in-law went to the vegetable seller. I fell asleep around 11:00 and my wife woke me up around 15:00 - 15:30. She said, 'There is an allegation that you raped G.' I did not do such a thing," he testified.

In response to questions from G.G.S.'s lawyers, defendant M.T. stated that he knew G.G.S. and defended himself as follows: "They are people we constantly interact with. She is a bit mentally childlike. I do not remember calling G. with a hand sign, but I raised my hand and asked where G.'s father was, and he replied, 'He went to İmamoğlu.'

The complainant T.S., G.G.S.'s mother, stated that she saw the defendant when he came to eat at around 09:00-09:30, saying, "After that, the defendant told my daughter to go to the back, and he took her to the olive grove behind the house where the cameras could not see. Around 11:00, G. came to me. I asked her why she was late. She told me that the defendant took her to the olive grove behind the house, stripped her there, and sexually assaulted her. Then I called Elif sister and explained the situation to her. She asked me, 'Are you sure?' She also spoke with G. G. locked herself in a room and said, 'I will kill myself.' Upon this, I called M.T., but he did not answer. Later, Elif sister called M.T.'s wife. She came to us and said, 'My husband would not do such a thing.' Then his wife went and brought the defendant from the house, and he denied it. Then my daughter G. said, 'Come to the back of the house, I will show you my footprints.' We went together, I, Elif Sert, and G. and saw the footprints there. Upon this, we called the defendant's wife. We said, 'Come see the footprints.' She came and saw them. Later, Elif Sert told me, 'Take your child to the hospital.' We first went to the city hospital together. When they said we needed to file a complaint, we went to the police station and filed a complaint. Previously, the defendant had been showing my child explicit videos. My daughter was afraid to tell me. I am filing a complaint," she said.
DISABLED GIRL DETAILED THE ABUSE
Later, the victim G.G.S.'s statement was taken in a sound recording under the supervision of a psychologist in the interview room. The disabled girl detailed how and where the defendant sexually assaulted her.
WILL BE TRIED IN CUSTODY
The court panel decided to continue the defendant's detention. The panel ordered that the disabled victim girl be sent to the Istanbul Forensic Medicine Institution to determine whether she had any mental illness or mental weakness at the time of the crime, whether this condition could be understood by non-medical professionals or those living around her or those who know her, whether her statements could be trusted, and whether the identified intelligence level affected her ability to perceive the legal meaning and consequences of the qualified sexual assault act, and whether she could defend herself physically and mentally against the act. The hearing was postponed to a later date for the completion of deficiencies.
