The penalty imposed on Murat E., who killed his brother Yoldaş E. while trying to prevent a sexual assault against his mother in Diyarbakır, has been announced. The court ruled that the incident was not considered murder but rather an exceeding of the limits of self-defense, sentencing the defendant to 2 years and 6 months in prison and ordering his release.
The decision regarding the brother who killed his drug-addicted older brother while trying to prevent a sexual assault on their mother in Diyarbakır has drawn attention.
According to a report in Nefes newspaper; the case related to the incident in the Bağlar district of Diyarbakır was heard in the Heavy Penal Court. Detained defendant Murat E. stated in his testimony that his brother had been a drug addict for a long time and attacked their mother on the day of the incident.
“HE WAS CHOKING MY MOTHER”
Defendant Murat E. stated that his brother came home naked and tried to forcibly take his mother away, saying, “I shot him in the foot to stop him, but he didn't stop. When I heard my mother's screams, I entered the room. He was choking my mother with his hand. I tried to save her but couldn't, so I shot him in the shoulder.”
Neighbors also testified as witnesses, stating that when they went to the house, they saw the mother with her hair disheveled and that she had been attacked.
“THE DEAD AND THE KILLER ARE BOTH MY CHILDREN”
Mother Faike E. stated in her court testimony that her deceased son had been a substance addict for about 20 years.
The mother, stating that her son came home naked on the day of the incident, said, “He was covering my mouth with one hand and trying to remove my clothes with the other. I bit his hand to free myself. My younger son saved me. I do not press charges.”
STRIKING STATEMENTS FROM THE WIFE
The deceased's wife, Elif D., stated that her husband subjected her and their children to violence, attempted to rape her, and became aggressive after using drugs. The woman, who stated she had previously received death threats, said she had filed for divorce for this reason.
COURT: EXCEEDED THE LIMITS OF SELF-DEFENSE
The court took into account reports determining that the deceased was under the influence of drugs during the incident. It was emphasized that the defendant first sought help and then acted to protect his mother.
The panel, concluding that Murat E.'s intent was not to kill but to save his mother, decided to evaluate the incident within the scope of exceeding the limits of self-defense. The defendant was sentenced to 2 years and 6 months in prison and was ordered to be released. The Regional Court of Appeal also found the decision lawful.
