The meeting between TBMM President Numan Kurtulmuş and the TİP delegation took place following the Constitutional Court's decision to invalidate Can Atalay's parliamentary membership. Kurtulmuş called for an extraordinary session of the TBMM on August 16. RETURN OF ATALAY'S MEMBERSHIP IS EXPECTEDThe reasoning of the decision stated that it was not possible to examine the request regarding an action that legally does not exist. The reasoned decision dated February 22 was published in the Official Gazette on August 1. Following the decision, Atalay's lawyers applied to the Istanbul 13th Heavy Penal Court for his release. Atalay also demanded his release and the recognition of his parliamentary membership again, referring to the court's decision. CHP, DEM Party, Saadet Party, Gelecek Party, TİP, DEVA Party, Democrat Party, and Emek Party also called for an extraordinary session of the Parliament with a joint petition. A response came from the Presidency of the Parliament to the call. Political parties were invited to the Parliament on August 16, Friday at 14:00 for Atalay. It is expected that the decision of the Constitutional Court will be discussed at the meeting and Atalay's membership will be restored. DECISIONS OF THE COURT OF CASSATION AND THE 13TH HEAVY PENAL COURT ON CAN ATALAYIn the past, the Constitutional Court had twice ruled 'violation of rights' for Atalay, who was elected as a TİP deputy from Hatay but could not leave Silivri's Marmara Closed Prison due to being a defendant in the Gezi trial. The Istanbul 13th Heavy Penal Court had sent the decision of the Constitutional Court to the Court of Cassation's 3rd Criminal Chamber twice. The Court of Cassation, stating that the convictions in the Gezi trial were upheld, did not recognize the decision of the Constitutional Court and rejected the request for release. The court had relied on the decision of the Court of Cassation, not the Constitutional Court. Now, the Istanbul 13th Heavy Penal Court also indicated that the Constitutional Court's latest decision is not related to the court. In its decision, the court emphasized that the Constitutional Court's decision was related to the dismissal of Can Atalay's parliamentary membership by the Grand National Assembly of Turkey, and ruled that there was no place for a decision to be made.
