In the indictment prepared by the Istanbul Chief Public Prosecutor's Office, Chief Prosecutor Akın Gürlek is referred to as the 'victim', while Cem Aydın is referred to as the 'suspect'.
FREEDOM OF EXPRESSION SCOPE EXCEEDED
In the prepared indictment, it was stated that the words used by suspect Aydın in a video he shared on social media, such as 'executioner of justice, mobile guillotine', were derogatory, damaging to the dignity of the other party, and hurtful, and that it was not possible to evaluate them within the scope of freedom of expression.
GÜRLEK WAS TARGETED
In the indictment, it was noted that Gürlek had served in the Peace Criminal Court and in Heavy Criminal Courts responsible for terrorism offenses in the past, and that he had become a target of terrorist organizations due to his duty. It was recorded that the words of suspect Aydın targeted Gürlek, who is a public official involved in the fight against terrorism.
REQUEST FOR UP TO 5 YEARS AND 4 MONTHS IN PRISON
In the prepared indictment, it was requested that suspect Aydın be sentenced to a total of 2 years and 2 months to 5 years and 4 months in prison for the crimes of 'publicly insulting a public official due to his duty' and 'targeting individuals who have participated in the fight against terrorism'. The indictment is currently being evaluated by the Istanbul Heavy Criminal Court to which it was sent.
