The lawyers of Selahattin Demirtaş, the former co-chair of the HDP who has been detained since November 2016, have applied to the Court of Appeals for their client's release. This application drew attention as it was made just before the deadline for the European Court of Human Rights' second violation ruling regarding Demirtaş, which will expire on October 8.
The former co-chair of the HDP, Selahattin Demirtaş, who has been detained in Edirne Prison since November 2016 despite the violation decisions of the European Court of Human Rights (ECHR) and the Constitutional Court, has had his lawyers file an application to the Court of Appeals for his release.
The Ankara 22nd Heavy Criminal Court completed the reasoned decision for the sentence given to Demirtaş in the Kobani case after 13 months, and in response to the approximately 30,000-page reasoned decision, Demirtaş's lawyers prepared a comprehensive 400-page defense.
A DECISION IS EXPECTED NEXT WEEK
The appeal application made for Demirtaş to the Ankara Regional Court of Appeals on September 24 has been registered with a case number. In this application, referencing the previous violation and release decisions made by the ECHR, the request for Demirtaş's release was made.
It is expected that the relevant chamber of the Court of Appeals will make a decision regarding this release request next week.
THE OBJECTION PERIOD EXPIRES ON OCTOBER 8
On the other hand, Turkey's objection period regarding the ECHR's second violation and release decision for Demirtaş also ends on October 8.
If Turkey does not object, the ECHR decision will become final. Therefore, attention is also focused on October 8.
Demirtaş's lawyer, Mahsuni Karaman, also recalled the human rights violation decision made by the European Court of Human Rights (ECHR) and stated that the date of October 8, 2025, is critical for the release process, describing October 8 as "the litmus test of the process."
A GREEN LIGHT FOR RELEASE FROM MHP
MHP's legal advisor, Feti Yıldız, also reminded that the ECHR decisions bind the Constitution regarding the expectation of release for former HDP co-chair Selahattin Demirtaş, stating, "While Article 90 of the Constitution stands there, of course, some things need to be done."
