The 12th Criminal Chamber of the Court of Cassation upheld the 1 year and 3 months prison sentence given to a person who shared someone else's phone number on social media with the note "Hello, I am looking for a serious marriage, serious inquiries only," for the crime of "violation of privacy."
A person living in Aydın shared a phone number belonging to a friend on a social media application account he created on Instagram with the note "hello, I want a serious marriage, those who are serious can call." The victim, who was called by others due to this post, filed a complaint against the person who made the post.
LOCAL COURT ACQUITTED
A lawsuit was filed against the identified person who made the post for the crime of "illegally providing or obtaining data." The Aydın 5th Criminal Court of First Instance, which conducted the trial, decided to acquit the defendant.
AN APPEAL WAS MADE TO THE COURT OF APPEALS
Upon the appeal of the decision, the 14th Criminal Chamber of the İzmir Regional Court of Appeals sentenced the defendant to 1 year and 3 months in prison on the grounds that the act constituted the crime of "violation of the right to privacy."
THE SUPREME COURT FOUND THE APPEAL DECISION APPROPRIATE
Upon the defendant's appeal, the case came to the Supreme Court. The 12th Criminal Chamber of the Supreme Court, which reviewed the appeal, unanimously upheld the conviction of the defendant, finding it in accordance with the law. The decision of the chamber stated that the procedures during the trial process were carried out in accordance with the rules and laws by the appellate court, and that the crime classification corresponding to the defendant's actions and the penalties were correctly determined by the court.
