DARK COMMERCIAL DESIGNS UNDER SCRUTINYIn a statement made by the Ministry of Commerce, it was reported that during the Board's meeting in September, decisions were made regarding many advertisements and commercial practices that are misleading and deceptive to consumers, and that deceptive commercial designs known as "dark commercial designs" worldwide were discussed. In the statement, it was noted that out of 144 files discussed in this month's meeting, 118 were found to be contrary to the legislation, and it was decided to impose a total administrative fine of 22 million 414 thousand 861 lira with a stop penalty regarding the said advertisements and commercial practices. The statement defined dark commercial designs as applications that are mostly found in online user interfaces and generally lead consumers to make choices that are not in their best interest, deceiving, forcing, or manipulating them.DIRECTIVE ADVERTISEMENTS ADDRESSEDIt was pointed out in the statement that, with the participation of 27 consumer protection authorities worldwide, including the Ministry, an international scan was conducted by the International Consumer Protection and Enforcement Network (ICPEN) regarding dark commercial designs in subscription services from January 29 to February 2, 2024, and that ex officio investigations were initiated as a result. It was emphasized that decisions were made regarding practices related to subscription services in this meeting. The statement mentioned that manipulative elements such as some subscription packages or additional services offered to consumers by default, and the emphasis on the "accept" option over the "reject" option in updated membership agreements were evaluated, and the following expressions were used: DECEPTION TO CONSUMERS IN SUBSCRIPTION PACKAGES"Additionally, practices such as the use of interface designs that make it difficult for consumers to complete the purchase of the subscription package they want without upgrading were addressed. In the meeting, it was stated that practices such as emphasizing that certain subscription packages are popular without specifying transparent criteria and numerical data, and requiring payment method information from consumers to offer free trial opportunities are misleading commercial methods that negatively affect consumer will. It was decided to impose administrative sanctions on companies engaged in such practices. "In the statement, it was noted that the Advertising Board's investigations into deceptive commercial designs that consumers encounter in various sectors in digital media continue, stating, "The Advertising Board evaluated a total of 1340 files in the 9 months of the year. An administrative fine of a total of 187 million 456 thousand 473 lira was imposed, in addition to a stop penalty, on 1173 files identified as misleading advertisements or unfair commercial practices."
