The "Bill on Amendments to Certain Laws Related to Health and the Decree Law No. 663," prepared by the AK Party and consisting of 29 articles, has been approved by the General Assembly of the Turkish Grand National Assembly (TBMM).

The bill titled 'Law Proposal for Amendments to Some Laws Related to Health and the Decree Law No. 663' prepared by the AK Party was discussed in the TBMM General Assembly.



PASSED IN THE ASSEMBLY



After the discussions regarding the bill, voting was conducted. As a result of the voting held in the TBMM General Assembly, the bill was accepted and enacted as law.



THE NUMBER OF FAMILY DOCTORS IN THE FIELD WILL INCREASE



According to the accepted law, the number of family doctors working in the field will be increased through the specialization in family medicine.



Those working as contracted family doctors according to the relevant law until January 1, 2025, will be able to receive family medicine specialization training based on the framework determined by the Medical Specialization Board without being subject to central placement, according to the results of the medical specialty examination. The training methods will be at least 6 years, either remotely or part-time. For those who have worked as contracted family doctors for at least 5 years before starting the training, it will be completed within at least 4 years. Those receiving contracted family medicine specialization training will benefit from the payments made for motivation, except for the payments made from revolving fund additional payments during their time spent in educational institutions.



The titles of nurse assistants and midwife assistants will be abolished, and programs for student enrollment in health vocational high schools in line with the title of dental prosthesis technician will be redefined. The statuses of nurse assistants and midwife assistants, as well as the students of these programs after graduation, will be unified under the status of health care technician.



MEDICAL PRODUCTS DERIVED FROM HEMP WILL BE SOLD IN PHARMACIES



According to the law, a provision is added to the Pharmaceutical and Medical Preparations Law to regulate the sanctions to be applied in case the movements of human medicinal products and special medical purpose foods within the supply chain are not reported to the tracking system for license or permit holders. Accordingly, license or permit holders will report all movements of human medicinal products and special medical purpose foods to the tracking system in accordance with the procedures and principles determined by the Ministry of Health.



Those who act contrary to this provision will be fined an administrative monetary penalty equal to twice the total sales prices of all products subject to the violation on the date of detection of the violation, and if the same act is repeated within one year, the administrative monetary penalty will be increased by one fold. With the amendment made to the Law on the Control of Narcotic Substances, the licensing or registration processes for medical products derived from hemp, health and support products, and personal care products will be carried out by the Ministry of Health. These products will only be sold in pharmacies. The procedures and principles regarding the permission and sale of these products, as well as the processing, import, and export of hemp, will be determined by a regulation to be issued by the Ministry of Health, taking into account the opinions of the Ministry of Interior and the Ministry of Agriculture and Forestry.



INCREASING THE NUMBER OF ORGAN DONORS IS BEING FACILITATED



On the other hand, the law facilitates arrangements to increase the number of organ donors and to make donations easy and safe. A citizen will declare that they leave their entire body, organs, or tissues for treatment and scientific purposes when healthy, using secure identity verification tools through the e-Government Gateway or the information systems established by the Ministry of Health.



The person will also be able to have organs or tissues taken from the deceased if they declare their official or written will in the presence of 2 witnesses. When an organ is taken from the donor, if the relatives do not give permission, the healthy will of the person will be taken into account. In the absence of such cases, the consent of the spouse, adult children, parents, or siblings present at the time of death will be sought, or if none of them are available, the consent of any relative present will be obtained for the removal of organs or tissues from the deceased.



Spouses and first-degree relatives of donors whose organs are transplanted will be given priority after urgent patients if they need organ transplantation. Declarations of organ donation will be recorded in the central registration system of the Ministry of Health in accordance with the 'Personal Data Protection Law'. Declarations of organ donation will be notified to the persons designated by the donor at the time of declaration, and will not be disclosed to anyone else before the determination of brain death.
