Chief Inspector M.K., who killed a person he caught with his wife at home in Elazığ, was sentenced to 10 years and 2 months in prison with good behavior and unjust provocation reductions. In his statement, the defendant M.K. said, "I did not shoot to kill the victim. As seen in the autopsy reports, I did not shoot at a single spot. I started shooting from the lower part of his body. I was unexpectedly attacked in my home at an unforeseen moment. I need the laws to protect me."

In the case of the chief inspector who killed a man he caught with his wife at home in Elazığ, the court announced its decision, applying a reduction for good behavior and provocation, sentencing the defendant to 10 years and 2 months in prison.

In the incident that occurred on September 5 last year, Chief Inspector M.K. encountered Orhan Ö. (44) at his home in the Çaydaçıra neighborhood during lunchtime. As a result of the ensuing fight, the chief inspector fired multiple shots with the gun at his waist. Orhan Ö., who was hit by the bullets, died at the scene, while Chief Inspector M.K. was arrested by the court he was brought to and sent to prison. In the final hearing of the case held at the Elazığ 3rd High Criminal Court, the detained defendant M.K. and the lawyers of the parties were present in the courtroom.

"BOTH OF US WERE INJURED DURING THE STRUGGLE"

In his statement, the defendant M.K. said, "From the moment I encountered the victim inside my house, the victim tried to stab me while hiding behind the door. I initially prevented it. During the struggle, both of us were injured. These are documented in the medical report. In the victim's autopsy report, there are records of injuries caused by my choking him, in addition to gunshot wounds. The victim's act of taking a knife and hiding, along with his messages saying 'I don't care if M.K. comes home anymore. We will have to meet, he knows himself,' is significant in terms of the victim's knife attack. The victim is in an immoral relationship. Realizing he would be exposed, he attempted to prevent the revelation of the relationship by attacking with a knife. The victim's presence in my house led him to attempt to escape by attacking with a knife due to the crime of trespassing. The fact that the victim is married and a father of three meant he would lose both his home and job if the relationship was discovered. For this reason, he hid and carried out a knife attack. At the time of the incident, the victim also said, 'I will kill you,'" he stated.

"I DID NOT FIRE TO KILL THE VICTIM"

M.K. stated that he stopped firing immediately after the victim's attack ended, saying, "If I wanted, I could have fired the remaining bullets in the gun, but I did not do such a thing. I did not fire to kill the victim. As seen in the autopsy reports, I did not shoot at a single spot. I started firing from the lower part of his body. The weapon I used during the incident is a semi-automatic pistol. Once loaded, you can fire until the bullets are finished. For me to have fired multiple times during the incident, the gun would have to be faulty or the bullets would have to be misfired. It is clear that the bullets fired during the incident did not require me to reload multiple times. Even after the incident ended, I could not shake off the fear I felt. My intention in the incident was definitely not to kill. I had to intervene because the knife was directed at me. My intention was not to kill, but to neutralize the attack on my life. The fact that I stopped shooting as soon as I realized the victim's attack shows that I did not have the intention to kill," he said.

"I NEED THE LAWS TO PROTECT ME"

M.K. stated, "After the incident, I informed the law enforcement officers about the situation. I did not leave the scene or run away. I was saddened by the outcome of the incident resulting in death. I would not have wanted such a situation to occur. I was unexpectedly attacked in my home. I have been deprived of my child, my job, and my freedom. Throughout my life, I have tried to live according to the laws and customs. Despite this, trouble found me in my home. I need the laws to protect me and I request that my victimization be believed. My intention in the incident was definitely not to kill. I had to fire. I was saddened by the outcome of the incident resulting in death. I would not have wanted the incident to happen," he expressed.

The court, announcing its decision, applied a reduction for good behavior and provocation to the defendant, sentencing him to 10 years and 2 months in prison.
