Businessman Besim Tibuk and his wife of 36 years, Serap Tibuk, decided to divorce last year. Although their long marriage has ended, disputes over compensation and alimony continued. Recently, the Court of Cassation found the 50 million lira compensation that Besim Tibuk is required to pay to be insufficient, stating in the reasoning of the decision that "the economic and social situation was not taken into account."
Businessman Besim Tibuk and his wife of 36 years, Serap Tibuk, have divorced, but the dispute over compensation and alimony has been taken to the Court of Cassation.
According to Ekol TV reporter İlker Turak's exclusive news, Serap Tibuk filed for divorce, claiming that her husband Besim Tibuk had subjected her to economic violence. She demanded 2.5 billion lira in material compensation and 1 billion lira in moral compensation.
COURT DECIDED BESİM TİBUK WAS AT FAULT
The 14th Family Court of Istanbul ruled that Besim Tibuk was at fault in the events leading to the divorce. The court ordered the payment of 500,000 lira in poverty alimony, 750 million lira in material compensation, and 100 million lira in moral compensation to Serap Tibuk.
COURT REJECTED THE MORAL COMPENSATION REQUEST
Besim Tibuk appealed the case. The Istanbul Regional Court of Justice reduced the poverty alimony to 350,000 lira, finding it excessive. The 750 million lira compensation was lowered to 50 million lira. The court rejected the request for moral compensation.
50 MILLION LIRA COMPENSATION WAS CONSIDERED LOW
The reduced material compensation, alimony amount, and the annulled moral compensation decision were taken to the Court of Cassation. The Court of Cassation found the 50 million lira compensation amount to be low and ruled for the annulment of the decision.
