Tevfik Köseoğlu lost his life in a traffic accident in Antalya, his wife Gülşah Esma Köseoğlu was left paralyzed, and their three children were seriously injured. The family faced a second blow from their lawyer after the accident. They reported the lawyer to the authorities for sending them 1 million Turkish Lira out of the 1 million 850 thousand Lira compensation paid by the insurance company, while showing various expense items for the remaining amount.
On March 29, in the Yeşilbayır neighborhood of Döşemealtı district in Antalya, a car driven by Tevfik Köseoğlu (32) was hit by a vehicle driven by Z. B. that came out from a side road.
WIFE DIED, HE BECAME PARALYZED
Tevfik Köseoğlu died at the scene, while his wife Gülşah Esma Köseoğlu (29) and their three children were seriously injured. Gülşah Esma Köseoğlu, who spent about 10 days in intensive care, suffered a partial paralysis, experienced a brain hemorrhage, and her heart stopped once. While the treatment of the mother and her children continues, a legal process has been initiated regarding the accident. Due to financial difficulties, the family agreed to work with a lawyer named C. E., registered with the Erzurum Bar Association, through an acquaintance and provided a power of attorney.
LAWYER DID NOT SEND 850 THOUSAND LIRA
It later emerged that the insurance company deposited 1 million 850 thousand lira into the account of lawyer C. E., and the family was not informed of this payment for 14 days. After the lawyer sent 1 million lira to the family and showed various expense items for the remaining amount, the family revoked the power of attorney through their new lawyer. The family, who filed a complaint against lawyer C. E. with the bar association, also reported the incident to the Antalya Chief Public Prosecutor's Office.
"I WANT TO RECOVER FOR MY 3 CHILDREN"
Gülşah Esma Köseoğlu stated that they had a very bad accident, saying, "I want to recover for my 3 children. I have been receiving physical therapy for 8 months. They also took our rights. I want the payment of the money that the lawyer did not give us for my children," she said.
"OUR AGREEMENT WAS ABOVE 7 PERCENT"
Vahdettin Güneş, Köseoğlu's father, stated that they contacted lawyer C. E. through an acquaintance and said they agreed on a 7% fee, adding, "He made my daughter sign and inflated his fee to 850 thousand lira by showing many things as expenses. Our agreement in the document we signed was above 7%. Moreover, he was supposed to send the money he received within a week, but he kept it in the bank for 14 days," he said.
"THEY THREATEN US WITH A LAWSUIT"
Vahdettin Güneş said, "My daughter and son-in-law had an accident on the eve of Ramadan. My son-in-law died, and 3 children were injured. My daughter has been receiving treatment in the hospital for 8 months. We do not know lawyer C. E., we have not even spoken on the phone. They sent him through an acquaintance from Erzurum. They said, 'This is our child, do not interfere.' My child had just come out of intensive care, and she was not in a condition to talk. They made her sign at the notary. They sent 1 million lira of the 1 million 850 thousand lira paid by the insurance, but did not give the remaining 850 thousand lira. On top of that, they are threatening to sue us. I want justice to be served," he said.
"SIGNATURES WERE OBTAINED WITHOUT AWARENESS"
Lawyer Halit Çınar, who stated that his client became disabled after the accident, said, "She is currently receiving treatment in Antalya. She is agreeing with a lawyer through her acquaintances regarding this process. This intermediation, as we call it, constitutes a crime under Article 48 of the Attorneyship Law. However, they have given a power of attorney to a lawyer they do not know and have never seen. In addition to the power of attorney, they are asked to sign another document at the notary in the blink of an eye. Since she was not in a position to sign at that moment, she was asked to put her fingerprint. Unbeknownst to them, they were made to fingerprint these documents, and the process was initiated," he said.
"THE FAMILY WAS SHOCKED TO LEARN THE PAYMENT WAS MADE TO THE LAWYER"
Lawyer Halit Çınar, who noted that the family approached him, said, "Under normal circumstances, their compensation should have been paid long ago. Upon this, we had a meeting with the insurance company. When the insurance said the payment was made to the lawyer's account days ago, the family was shocked. When the family called the lawyer and explained that they were in a very difficult situation, they were only told to 'be patient.' The lawyer said, 'I just realized the money was deposited, I will send your rights immediately,' and only transferred 1 million lira of the 1 million 850 thousand lira compensation to the family. Then he refused to give the remaining money, saying, 'I calculated, this is how much your right is,'" he said.
DIFFERENT EXPENSES WERE SHOWN FOR 850 THOUSAND LIRA
Çınar noted that his client agreed with lawyer C. E. on a 7% deduction rate, saying, "He made a deduction of approximately 45%. This situation is clearly above the legal upper limit of 25%. The lawyer does not have the right to make such a deduction. We openly condemn our colleague's attitude. First, a revocation document was prepared at the notary, and then a criminal complaint was filed with the Chief Public Prosecutor's Office. In the documents presented by the lawyer, where it is understood that the client was made to fingerprint while not in a sound state of mind, various expense items were shown, including 250 thousand lira for filing a lawsuit, 150 thousand lira for the insurance application, and 100 thousand lira for the guardianship case, thus creating the impression that he deserved all the money. Necessary procedures have been initiated for our client to receive all her rights, and we are following the legal process with the prosecutor's office," he said.
"SUCH SITUATIONS OCCUR IN MONEY MATTERS"
Lawyer C. E. stated, "We made our attorney contract. There is no situation of 850 thousand lira. Of the 1 million 850 thousand lira, 250 thousand lira is the attorney fee. It is written this way in the records. The parties read the contract. In fact, family members read it from hand to hand. When money is involved, we generally encounter such situations."
"I did not mention the prices for this case. We filed lawsuits against each other. I reported the individuals, they came to threaten me. I walked around with protection for 3 days. Such situations occur in money matters," he said.
