THE TAXI ISSUE HAS BEEN TAKEN TO COURT
The Istanbul Metropolitan Municipality (IMM) was preparing to hold a tender today for 150 taxi plates in the first phase of its plan to introduce 2,500 new taxi plates into service. The Istanbul Taxi Drivers and Automobile Tradesmen Chamber applied to the court for the cancellation of the tender process and the suspension of its execution. The plaintiff argued that the IMM does not have the authority to tender taxi plates for 29 years and that this process is contrary to the law. The Istanbul 14th Administrative Court initially rejected the request for a stay of execution. However, the Istanbul Regional Administrative Court's Sixth Administrative Case Department evaluated the appeal and decided to suspend the execution.
COURT DECISION TO SUSPEND EXECUTION
The court decision stated that under the Municipal Law No. 5393 and the State Tender Law No. 2886, municipalities can lease taxi plates for a maximum of 10 years, but the IMM's tender for a duration of 29 years is contrary to the law. The estimated value of each taxi plate in the tender was set at 4 million 250 thousand TL plus VAT, and the temporary guarantee amount was announced as 127 thousand 500 TL. However, it was stated that the tender process has currently been suspended following the court's decision. It was learned that the trial regarding the contested process will continue in the relevant Administrative Court, and that the IMM will carry out the tender once the process is clarified after the court's decision.
