The request for a ban on access to the footage and news regarding nurse Hazel Dırık Bağrıyanık, who was arrested for allegedly abusing a 5-day-old baby in Kahramanmaraş, was rejected by the court. The judge stated that the incident is of public interest, that the public's right to information is superior to personal rights, and that sharing should be evaluated within the scope of freedom of the press.

After the emergence of images showing nurse Hazel Dırık Bağrıyanık (33) applying violence to a 5-day-old baby in Kahramanmaraş, she was arrested and claimed that her personal rights were violated, requesting the Kahramanmaraş 1st Civil Court to impose a ban on access to the images and news. The judge rejected the request on the grounds that 'the actions of the requester subject to the judicial process occurred in a public space, and sharing this information is not an attack on personal rights, but a requirement of press freedom.'

Nurse Hazel Dırık Bağrıyanık, who is accused of applying violence to Deniz Esin Bozoklar (5), the baby born to the couple Sema and Abdullah Bozoklar at Kahramanmaraş Sütçü İmam Health Practice and Research Hospital in 2021, and causing her to remain physically and mentally disabled, was arrested by the Kahramanmaraş 10th Criminal Court, where she is being tried for the crime of 'intentional injury' with a request for up to 3 years in prison.

REQUESTED A BAN ON ACCESS TO THE IMAGES

Bağrıyanık, through her lawyers, applied to the Kahramanmaraş 1st Civil Court, requesting a ban on access to the images of the moments of violence against the baby, the news made about the images, and social media posts. In her justification for the request, Hazel Dırık Bağrıyanık stated that the incident occurred 5 years ago and therefore has no news value, that her right not to be defamed by having her name explicitly written and her face shown was violated, that she received insults and threats, and that the shares were made with the intention of humiliating her honor and dignity.

THE JUDGE REJECTED WITHOUT HESITATION

"THE PUBLIC'S RIGHT TO INFORMATION..."

The judge explained the reason for the rejection by stating that the incident subject to the news is supported by security camera footage: "The request for the removal of the relevant news content is not deemed appropriate, and the incident subject to the news involves acts of violence against a defenseless baby. The public's right to information about such serious cases occurring in health institutions providing public services and concerning public safety is superior to the individual's right to be forgotten. The relevant incident is supported by security camera recordings and is based on a concrete event that resulted in the arrest of the requester by the Kahramanmaraş Duty Peace Criminal Court. According to Articles 26 and 28 of the Constitution, the press has the freedom to convey events of public interest. The actions of the requester subject to the judicial process occurred in a public space, and sharing this information is not an attack on personal rights, but a requirement of press freedom. In the balance test conducted between the personal rights of the requester and the public's right to information; due to the severity of the incident, the fact that the victim is a baby, and elements of public safety, it has been determined that the public's right to information prevails. Therefore, the request for the removal of the URL content subject to the news has been rejected."
