A father in Konya, who noticed bruises on his 1.5-year-old daughter's arms and legs, as well as redness and tissue damage on her face, filed a lawsuit against his ex-wife on charges of violence. The child's caregiver testified in court, saying, "She slapped the child and kicked her with her foot. She hit the child with a tablet. She applied foundation to prevent the father from seeing the injuries." The mother, who is also accused of giving the child sleeping pills, is facing a prison sentence of up to 2 years.

In Konya, the couple A.G. (43) and B.Ş. (34) divorced one month after their daughter R.M.G. was born in 2023, and the custody of their daughter was granted to the mother, B.Ş. A.G. noticed that his daughter had constant bruises on her arms and legs and redness and tissue damage on her face during several visits to the Judicial Interview Room to see her.

FATHER FILED A COMPLAINT

Upon receiving a video from B.Ş. showing her trying to force R.M.G. to drink soda from a bottle, A.G. filed a complaint with the prosecutor's office, alleging that his ex-wife B.Ş. was abusing their daughter R.M.G. As part of the investigation initiated by the Konya Chief Public Prosecutor's Office, a forensic medical report was requested for R.M.G. The report stated that there was no communication with the child, that she could only make simple sounds, that she was developmentally appropriate for her age, and that based on the examination, the nature of the incident, and the circumstances, it was concluded that she could not defend herself regarding the alleged 'Intentional injury' incident in terms of her physical and mental health.

UP TO 2 YEARS OF IMPRISONMENT SOUGHT

After the investigation was completed, an indictment was prepared against B.Ş. for "Simple injury" and "Violation of obligations arising from family law," seeking a total of up to 2 years in prison, with each charge carrying a penalty of up to 1 year.

ALLEGATION OF "BEING PUT TO SLEEP WITH SLEEP SYRUP"

The indictment also included the statement of R.M.G.'s caregiver F.B., who testified that she witnessed B.Ş. putting R.M.G. to sleep by giving her sleep syrup and hitting her. The indictment was accepted by the 5th Criminal Court of First Instance. During this process, the custody of R.M.G. was temporarily granted to the father, A.G.

"NOT SLEEP SYRUP, BUT COLIC MEDICINE"

B.Ş., who began to be tried in court, denied the allegations and stated in her defense: "My child has an active nature. These injuries occurred due to her own movements. I did not harm her. My child could not sleep because she had colic (a condition characterized by prolonged and uncontrollable crying of unknown cause). Therefore, I consulted a doctor and took medication. I used it 2-3 times. Later, I stopped it because another medication was recommended; there was no situation where I used this medication for a long time. I never gave my child any sleep medication. I used the medication because doctors said it could be used in such situations. I fulfilled my obligations arising from family law. I finish work at 24:00 and come to my child. I never threw my child. I take very good care of my child; her development is good. My older child has not hit my daughter; their communication is good, and I have videos regarding this. I have daily video recordings of the caregiver during the time she took care of the child."

"WE DIDN'T FORCE HER TO DRINK SODA, WE WERE CURIOUS ABOUT HER REACTION"

Regarding the allegation of forcing R.M.G. to drink soda, B.Ş. stated, "Neither I nor my mother forced the child to drink soda. My brother recorded a video to see what kind of reaction she would give by showing her the soda. We sent this to my husband. I want to ask my husband what we are doing here? I don't know why he complained about me. Yesterday, I played with my child and my husband; I do not accept the accusation against me," she said.

CAREGIVER: "I WITNESSED THE MOTHER HITTING"

F.B., R.M.G.'s caregiver, was also heard as a witness in court. F.B. claimed that R.M.G. was subjected to violence by her mother, stating, "I was the caregiver of the defendant's child. I witnessed the child being hit by her mother. As far as I remember, it happened before last year's Ramadan Bayram; I saw her hitting the child. She slapped her and kicked her with her foot. She threw a pillow at the child with her foot," she said.

"I DIDN'T SEE HER GIVING SLEEP MEDICINE, BUT SHE WAS SAYING IT"

Continuing her statement, F.B. said, "I didn't see her giving sleep medicine, but she was saying it. When the child came to me, she was in a lethargic state. This also happened last year's Ramadan. The child was being given medication since the time she was handed over to me. She was constantly insulting the child. When the child got sick, she didn't take her to the hospital. When she brought the child to me, she would curse and say, 'Take this away from here.' When I asked why she did this, she said she didn't like the child and was doing it to get money from the child's father. After the child left me, her mother didn't change her diaper. I could tell because when she came to me, her urine was up to her back," she said.

"SHE PUT FOUNDATION ON THE CHILD SO THE FATHER WOULDN'T SEE THE INJURY"

In response to the court president's question, "Did you see her hitting the child?" F.B. said, "While the child was with me last year's Ramadan, she took the child from my arms and took her to the next room. I saw the incident with my own eyes; she hit the child with a tablet. My guest also saw the incident. She put foundation on the child so the father wouldn't see the injury." The court panel adjourned the hearing.
