A development that delighted the residents occurred in the legal process that began after the titles of dozens of families living in Poligon Neighborhood, Sarıyer, Istanbul, were transferred to private companies through auction. The Istanbul 14th Administrative Court annulled the sale on the grounds of "violation of property rights."
THE PROCESS BEGAN IN 2021
The area, covering seven buildings with approximately 35 households, was declared a "reserve construction area" in 2021. Although an annulment decision was initially made in the lawsuit filed by the rights holders, the legal process continued as the appeals court overturned the decision.
Following an amendment to Law No. 6306 on the Transformation of Areas Under Disaster Risk in 2023, a share sale auction was held for the area. While the residents stated that they learned their titles were put up for sale through a notification to the mukhtar's office, the titles were transferred to Pelit İnşaat and Nar Enerji. It was reported that the amounts deposited to rights holders for Bosphorus-view apartments ranged between 1,270,000 TL and 2,500,000 TL.
ANNULMENT ON GROUNDS OF "VIOLATION OF PROPERTY RIGHTS"
According to a report in Sözcü, the Istanbul 14th Administrative Court examined the sale within the scope of assessments that the titles were sold without the knowledge of the rights holders and at well below their actual value. The court decided to annul the sale on the grounds of "violation of property rights."
With this decision, the residents, who had long feared losing their homes, achieved a significant legal gain. The court's annulment rendered the controversial sale invalid, while a new process began for the rights holders.
