The justification for the re-arrest decision regarding manager Ayşe Barım, who is being tried in the Gezi Park case, has emerged. The Istanbul 26th High Criminal Court cited the Forensic Medicine report on Barım's health condition as a reason for her release, while the Istanbul 27th High Criminal Court, which evaluated the same report, accepted the prosecution's objection by stating, "There is no obstacle to her remaining in prison."
The justification for the re-arrest decision regarding manager Ayşe Barım, who is being tried with a request for up to 30 years in prison in the Gezi Park case, has emerged. The difference in interpretation of the Forensic Medicine report was decisive in the different decisions made by two courts.
Manager Ayşe Barım, who is being tried on the grounds of being one of the planners of the Gezi Park events in Taksim, had been in custody since January 27 on charges of "aiding and abetting an attempt to overthrow the Government of the Republic of Turkey." Recently, the Istanbul 26th Heavy Penal Court had released Barım under judicial control and house arrest, taking into account the health report from the Forensic Medicine Institution.
OBJECTION TO THE RELEASE DECISION
The prosecution objected to the release decision. The Istanbul 26th Heavy Penal Court, which examined the objection, rejected this application and sent the file to a higher court. The Istanbul 27th Heavy Penal Court, which took up the file, accepted the objection and ruled for Barım's re-arrest.
It was learned that Barım was taken to the hospital due to health problems after her release. Following the new arrest decision, police teams were reported to have gone to the hospital.
"THERE IS NO OBJECTION TO HER STAYING IN PRISON"
According to the details of the decision, the 26th Heavy Penal Court evaluated the Forensic Medicine report as "Barım cannot stay in prison" and made it the basis for the release. However, the 27th Heavy Penal Court, which examined the same report, concluded that "there is no obstacle to her staying in prison" and accepted the prosecution's objection. Journalist Ceylan Sever announced the decision on her social media account with the following statements: "I have reached the justification of the court that issued the arrest warrant for Ayşe Barım. The 26th Heavy Penal Court used the Forensic Medicine report as a basis for release. However, the 27th Heavy Penal Court ruled that the same report did not constitute an obstacle to staying in prison."
