The regulation envisaging an increase in the minimum pension to 23,552 lira as of July 2026 has been published in the Official Gazette. The regulation also includes changes in the areas of tax, energy, tourism, transportation, private educational institutions, PTT, and cybersecurity.
The Law on Amendments to Certain Laws and Decree-Laws No. 7590 was published in the Official Gazette.
MINIMUM RETIREMENT PENSION BECAME 23,055 LIRA
With the law, the minimum retirement pension paid per file was increased from 20,000 lira to 23,552 lira. The regulation will apply from the July 2026 payment period.
RULES FOR PROBATIONARY DRIVERS HAVE BEEN CHANGED
Those who obtain a driver's license for the first time and those who re-obtain a license after its revocation will be considered probationary drivers for two years.
During this period, the probationary driver documents of those who commit a violation requiring the temporary withdrawal of the license, those who exceed 75 penalty points, or those determined to have driven under the influence of alcohol above 0.20 promille will be cancelled.
PREMIUM SUPPORT FOR TOURISM FACILITIES
Private accommodation facilities with tourism operation certificates will be provided with premium support for the insured persons they employ during the May-December 2026 period. The support will be offset against the premiums employers will pay to the Social Security Institution and will be covered from the Unemployment Insurance Fund.
Facilities with premium debts, those that do not submit their declarations on time, or those determined to employ undeclared workers will not benefit from the support.
TAX REGULATION FOR NUCLEAR ENERGY INVESTMENTS
Certain transactions related to nuclear power plant investments were exempted from stamp tax. A Value Added Tax exemption and refund opportunity were introduced for construction works and deliveries of machinery and equipment carried out within the scope of these investments.
For certain borrowings made for nuclear power plant investments, the corporate tax rate will be applied as 25 percent instead of 50 percent until the end of 2045.
SPECIAL CONSUMPTION TAX REGULATION FOR VEHICLES
The law introduced a minimum flat Special Consumption Tax for certain vehicles. Accordingly, the calculated Special Consumption Tax for certain vehicles cannot be less than 30,000 lira for L-class vehicles and 100,000 lira for other vehicles.
The President was authorized to determine different tax amounts based on the engine power, cylinder volume, drive system, range, battery capacity, emission value, and carrying capacity of vehicles.
NEW PENALTIES FOR PRIVATE EDUCATIONAL INSTITUTIONS
If international schools enroll Turkish Republic citizen students or provide education to these students, an administrative fine will be imposed, and the institution's operating permit and license will be cancelled.
Regulations regarding the qualifications of teachers, administrators, and expert instructors to work in private educational institutions were also changed.
PRINCIPLE OF RECIPROCITY IN PUBLIC PROCUREMENT
The President may decide to apply the advantages granted to domestic bidders and domestic goods in public procurement to bidders resident in European Union countries and products originating from the European Union, based on the principle of reciprocity.
WORKING STATUS OF PTT PERSONNEL CHANGED
PTT personnel other than those working under the Labor Law will be employed with an administrative service contract. The principles regarding the salaries, social rights, promotion, assignment, and termination of contracts of the personnel will be determined by the PTT Board of Directors.
The law also includes transitional provisions regarding the transfer of existing personnel to the new status and the appointment of some employees to other public institutions.
NEW POWERS FOR THE CYBERSECURITY PRESIDENCY
The authority to make policies and regulations regarding internet domain names was given to the Cybersecurity Presidency.
In cases where delay is detrimental, the Presidency may take a precautionary measure upon the request of security and intelligence institutions. The decision must be implemented within at most two hours and submitted for the approval of the criminal judge of peace within 24 hours.
PENALTIES IN THE TRANSPORTATION SECTOR RE-REGULATED
Administrative fines to be applied to those who act contrary to their obligations in road, railway, maritime, and dangerous goods transportation were re-determined.
Different amounts of fines will be applied depending on the type of violation for the transport of prohibited dangerous goods, conducting activities without necessary documents, violating railway safety rules, and violations of maritime legislation. For some violations, the fine may be up to 10 million lira.
Some provisions of the law will enter into force on different dates. The regulation regarding the minimum retirement pension will apply from the July payment period, and the change regarding premium rates will apply on August 1, 2026. Most of the other provisions entered into force on the date of publication.
"IBAN VICTIMS" REGULATION ALSO IN THE OFFICIAL GAZETTE
On the other hand, the "Law on Amendments to Certain Laws Regarding the Effective and Efficient Functioning of the Judiciary," referred to in public as the "12th Judicial Package," was also published in the Official Gazette.
The penalty for persons whose participation in the crime of fraud is limited to providing information and tools that enable the use of a bank account, credit card, payment instrument, or crypto asset account to another person will be reduced by half.
Before the law entered into force, the files of some defendants who had been sentenced for these crimes and whose files were under judicial review will be sent back to the courts of first instance for re-evaluation.
Some convicts in the execution phase may also benefit from the provisions of effective remorse if they fully compensate the victim's damages within six months.
