A prosecution has been prepared against social media influencer Murat Övüç, who was arrested after a video featuring him wearing a headscarf, with a request for up to three years in prison. The indictment describes Övüç as "a suspect exhibiting feminine movements and identifying himself as gay."

After the video of the headscarf-wearing social media phenomenon Murat Övüç, an indictment was prepared against him for the crime of "inciting the public to hatred and hostility." The Chief Public Prosecutor's Office of Küçükçekmece sent the indictment, prepared on the 46th day of Övüç's detention, to the criminal court of first instance.

The indictment included the statement that Övüç "mocked the headscarf, which is one of the important obligations of the Islamic religion, as the suspect, who exhibits feminine movements and identifies himself as gay, is a recognized person, and the post poses a clear and imminent danger of undermining social peace and disturbing public order by reaching a wide audience."

PRISON SENTENCE REQUESTED FROM 1 TO 3 YEARS

The prosecution claimed that Övüç committed the crime attributed to him by publicly inciting other segments of the public, requesting a prison sentence of 1 to 3 years for the crime of "publicly inciting the public to hatred and hostility."

The indictment included the following statements about Övüç:

"According to the Islamic religion, the headscarf is not seen as a 'symbol,' but as part of a worship and modesty obligation, meaning that its significance is not symbolic but a command; in religious terms, the headscarf in Islam is associated with obeying God's command, protecting privacy, the principles of modesty and chastity, and avoiding conspicuous display, and it is not defined as a badge in the Quran and jurisprudence, but rather, due to the acceptance of modesty as a religious obligation, it is covered to worship God. The headscarf is seen by some as a symbol of identity in discussions about prohibitions, public space, and political polarization; in short, according to the Islamic belief, modesty is a religious obligation, not a symbol.

It has been observed that the suspect used the expressions "I am gay" in a program presented by programmer Armağan Çağlayan, which was broadcast on the social media platform youtube.com, and that in his publicly shared posts, his body language, facial expressions, gestures, clothing, movements, manner of speaking, and tone of voice exhibited feminine behavior patterns outside the widely accepted male behavior patterns in society. It has also been understood that the suspect, who exhibits feminine movements and identifies himself as gay, mocked the headscarf, which is one of the important obligations of the Islamic religion, and that due to the suspect being a recognized person, the post poses a clear and imminent danger of undermining social peace and disturbing public order."
