The aim of the changes made in the Implementation Regulation of the International Labor Force Law is to increase the registration of foreigners in the working life in Turkey and to facilitate the work permit exemption procedures for foreigners who will work in jobs, professions, and sectors that will contribute to Turkey's development. EXEMPTION FROM PERMIT IS NOT PROVIDEDWith the amendment made by the Ministry of Labor and Social Security in the Implementation Regulation of the International Labor Force Law, in addition to facilitating the work permit exemption procedures for foreigners who will work in jobs/professions/sectors that will contribute to Turkey's development, it is also aimed to increase the registration of foreigners in Turkey.
The work permit exemption regulated under the International Labor Force Law is a type of work permit that will not exempt foreigners from the obligation to obtain a permit; instead, a different process will be implemented for the application method and evaluation of the application, and ultimately, a permit will still be issued to foreigners.MINISTRY WILL CARRY OUT WORK PERMIT PROCESSESThe scope of work permit exemptions has been expanded to attract qualified foreigners to our country and to increase registration. Among the foreigners evaluated within the scope of work permit exemption are different groups such as those who will work in scientific, cultural, artistic, and sports activities, academics, researchers, professionals who will work in oil and natural gas exploration and extraction activities, seafarers, professional athletes, tour operator representatives, and interns. With the regulation made, those under temporary protection and foreigners holding humanitarian residence permits who are reported to the Ministry of Labor and Social Security by the Ministry of Interior will be able to work under the work permit exemption. On the other hand, the Ministry will continue to carry out work permit processes for those from these groups who need to obtain a work permit. Provided that there is a favorable opinion from the Directorate of Communications, foreign press members who come to Turkey under the permanent press card will also be given the opportunity to work under the work permit exemption. EXEMPTION PERIOD FOR THOSE WHO WILL PROVIDE IMPORTANT SERVICES TO THE COUNTRY INCREASED FROM 6 MONTHS TO 3 YEARSWith the regulation, it is aimed to strengthen the Turkey brand by ensuring the qualified representation and promotion of Turkey in all areas through international public opinion and all means and methods of communication. The exemption period for those who will provide significant services to the country in various fields has been increased from 6 months to 3 years. The maximum duration of work permit exemption granted to foreigners who can provide significant services and contributions to Turkey in economic, socio-cultural, and technological fields, as well as in education, has been increased from 6 months to 3 years, as reported by relevant public institutions and organizations. With the favorable opinion of the Ministry of Youth and Sports or the Turkish Football Federation, professional foreign athletes and coaches, as well as sports physicians, sports physiotherapists, sports mechanics, sports masseurs, or similar sports personnel coming to Turkey have also been facilitated regarding work permit exemption. SPECIAL ARRANGEMENT FOR TOUR OPERATORSIn the calculation of the duration of work permit exemptions for foreigners who will work as tour operator representatives, the calendar year will be taken as a basis. Additionally, with the regulation, the 30-day threshold period starting from the legal entry date into Turkey, during which the foreigner can apply for a work permit exemption, has been removed, allowing the foreigner to apply for a work permit exemption during the period they are legally present in Turkey.
