Ten more articles regarding the increase of traffic fines were approved in the Turkish Grand National Assembly. Accordingly, those who drive despite having their licenses revoked and those who flee after the police's "stop" warning will face a fine of 200,000 TL, drivers who exit their vehicles with the intent to attack will be fined 180,000 TL, and a fine of 150,000 TL will be imposed for the detection of alcohol or stimulants. Here are all the details regarding the fines that will hit drivers' pockets.

10 more articles of the Draft Law on Amendments to the Highway Traffic Law, which includes regulations aimed at increasing traffic fines, were accepted in the General Assembly of the Grand National Assembly of Turkey (TBMM).

According to the articles accepted in the General Assembly, it will be mandatory to obtain permission from the General Directorate of Highways for vehicles that have special characteristics in terms of weight and dimensions, which cannot be transported by other transportation systems and must be transported despite exceeding the transport limit.

A road usage fee will be charged by the institution or organization responsible for the construction, maintenance, and operation of the road for the transport of special loads and their entry into traffic for vehicles subject to special permission.

The road usage fee will be determined and announced by the General Directorate of Highways for each calendar year, taking into account the tonnage per axle, the number of axles, the transport distance, and the fee corresponding to the reduction of the project life of the highway.

The procedures and principles for the permission to be granted to vehicles subject to special permission for the transport of special loads and their entry into traffic will be determined by regulation issued by the Ministry of Transport and Infrastructure, taking into account the views of the Ministry of Interior.

If support from traffic police is received for the transport of special loads, a service fee of 16,000 lira will be charged for each day of support, and this fee will be increased each year according to the revaluation rate determined and announced in accordance with the repeated Article 298 of the Tax Procedure Law for the previous year. This service fee will be recorded as income in the general budget.

200,000 TL FINE FOR DRIVING WITHOUT A LICENSE

Those who drive motor vehicles without a driver's license will be fined 40,000 lira, and those who drive motor vehicles despite the temporary or precautionary revocation of their driver's license by courts, public prosecutors, or authorized officials specified in the law will be fined 200,000 lira.

Those who drive motor vehicles despite their driver's license being revoked will also be subject to a 200,000 lira administrative fine. Additionally, the operator who allows the driving of motor vehicles will be fined 40,000 lira based on the registration plate.

Unless there is a contrary sign on the highways, regulations will be made regarding lane-following rules for vehicles such as trucks and tractors, excluding motorcycles, cars, vans, minibuses, and buses. In this context, drivers will be required to go in the same direction while using vehicles other than motorcycles, cars, vans, minibuses, and buses.

Drivers will not be able to use the left lane except for overtaking and turning on roads with two lanes, and will not be able to use the second lane from the right except for overtaking on roads with more than two lanes, and will not be able to use any lane other than the two rightmost lanes except for turning left on roads with more than two lanes.

Additionally, drivers will not be able to drive their vehicles in the opposite direction on divided highways within residential areas.

Drivers will not be able to drive their vehicles in the opposite direction on highways or divided highways outside residential areas.

No vehicles will be driven on pedestrian paths, and vehicles other than bicycles and electric scooters will not be driven on bicycle paths and lanes. Drivers will not be able to drive vehicles other than those permitted on roads closed to vehicle traffic or reserved for certain vehicles.

On the other hand, drivers will not be able to stop their vehicles on the highway in a way that obstructs or endangers the passage of other vehicles while driving in a column, group, convoy, or individually, in a manner that partially or completely obstructs the flow of traffic.

HIGH FINES FOR AGGRESSIVE DRIVERS

Those who change lanes multiple times in a row in a way that disrupts or endangers traffic, those who drive their vehicles in the opposite direction on highways or divided highways outside residential areas, and those who stop their vehicles on the highway in a way that obstructs or endangers the passage of other vehicles while driving in a convoy or individually will be fined 90,000 lira each. Additionally, the driver's licenses of these drivers will be revoked for 60 days, and their vehicles will be banned from traffic for 30 days.

With the proposal accepted by the AK Party in the General Assembly, no administrative fines will be imposed for stopping vehicles on the highway during meetings and demonstrations organized in accordance with the form, conditions, and procedures specified in the law, and this action will not constitute an offense.

Drivers who persistently follow another vehicle with the intent to attack or get out of the vehicle for this purpose will be fined 180,000 lira, their driver's licenses will be revoked for 60 days, and their vehicles may be banned from traffic for 30 days.

Driver's licenses of drivers whose licenses are revoked for driving in the opposite direction or for persistently following another vehicle with the intent to attack or getting out of the vehicle for this purpose will be returned after undergoing a psychotechnical evaluation.

For drivers whose licenses are revoked due to non-compliance with traffic flow rules on highways, those whose licenses are revoked for the second time within 5 years from the date of the last violation will have their licenses canceled. Those whose driver's licenses are canceled will need to attend driving courses and successfully obtain a motor vehicle driver's certificate in the exams to be able to obtain a driver's license again.

For these individuals to start training at driving courses, it will be mandatory that the time specified in the reasons for revocation has passed since the date of revocation, that all administrative fines imposed under the law have been collected, and that a document showing that there is no obstacle to driving as a result of the psychotechnical evaluation to which they will be subjected is presented to the driving course.

PENALTIES FOR REPEATED RED LIGHT VIOLATIONS WILL INCREASE GRADUALLY

Those who do not comply with the warnings and signals of traffic police or other authorized persons in special uniforms or carrying signs will be fined 3,000 lira. Drivers who do not comply with traffic lights will be fined 5,000 lira.

Those who do not comply with the matters specified or shown by traffic signs, devices, and road markings, as well as other rules, prohibitions, obligations, or liabilities related to traffic safety and order shown in the regulation will be fined 1,000 lira each.

Penalties for drivers who violate red lights will be increased gradually in cases of repeated violations. Drivers who violate red lights will be fined 10,000 lira for the second violation within one year from the date of the last violation, 15,000 lira for the third violation, 20,000 lira for the fourth violation, 30,000 lira for the fifth violation, and 80,000 lira for the sixth violation.

In inspections conducted while stationary or in motion, those who flee despite police warnings and signals will be subjected to an administrative fine of 200,000 lira, their driver's licenses will be revoked for 60 days, and their vehicles will be banned from traffic for 60 days.

Drivers who cause traffic accidents by violating red light rules will have their driver's licenses revoked for 60 days. Those found to have violated the rule of obeying red traffic signals three times within one year from the date of the last violation will have their driver's licenses revoked for 30 days, those found to have violated it four times will have their licenses revoked for 60 days, and those found to have violated it five times will have their licenses revoked for 90 days. The driver's licenses revoked in this context will be returned at the end of the revocation period, provided that it is determined that there is no obstacle to obtaining a driver's license after the driver undergoes a psychotechnical evaluation.

Those found to have violated the rule of obeying red traffic signals six times within one year from the date of the last violation will have their driver's licenses canceled. For those whose driver's licenses are canceled under this article, it will be necessary to attend driving courses and successfully obtain a motor vehicle driver's certificate in the exams to be able to obtain a driver's license again. For these individuals to start training at driving courses, all administrative fines imposed under the law must be collected, at least one year must have passed since the date of the driver's license cancellation, and it will be mandatory to present a document showing that there is no obstacle to driving as a result of the psychotechnical evaluation and examination by a psychiatry specialist.

150,000 TL FINE FOR DRUNK DRIVERS

Drivers found to have consumed drugs or stimulants will be subjected to an administrative fine of 150,000 lira, and their driver's licenses will be canceled, and the provisions of the Turkish Penal Code will also be applied to these individuals.

According to the accepted articles, technical devices or test kits will be used by law enforcement to determine whether drugs or stimulants have been used or to detect the amount of alcohol in the blood.

As a result of the detection, the administrative fine for drivers found to be driving with an alcohol level above 0.50 promille will be increased from 700 lira to 25,000 lira.

For those whose driver's licenses are revoked due to driving under the influence of alcohol, if the violation occurs a second time, the administrative fine will be increased from 877 lira to 50,000 lira. These drivers will be subjected to an administrative fine of 150,000 lira if the violation is repeated three times or more.

Drivers found to have consumed drugs or stimulants will be subjected to an administrative fine of 150,000 lira, and their driver's licenses will be canceled. The provisions of the Turkish Penal Code will also be applied to these individuals.

For those whose driver's licenses are canceled to obtain a driver's license again, it will be necessary to attend driving courses and successfully obtain a motor vehicle driver's certificate in the exams. For these individuals to start training at driving courses, at least 5 years must have passed since the date of the license cancellation, all administrative fines imposed under the law must be collected, drivers must pass the psychotechnical evaluation, and it will be mandatory to present a health board report from official health institutions showing that there is no obstacle to driving.

THERE IS A FINE FOR NOT HAVING MEASUREMENTS DONE

Drivers who do not have measurements done to determine whether drugs or stimulants have been used or the amount of alcohol in the blood will be fined 150,000 lira, and their driver's licenses will be revoked for 5 years.

To return temporarily revoked driver's licenses, it will be required that all administrative fines imposed under the law on the relevant person have been collected.

Those who have driven vehicles for the transportation of goods and passengers under the influence of alcohol or drugs a total of three times within the last 5 years from the date of the last violation will have their licenses canceled. For those whose driver's licenses are canceled to obtain a driver's license again, it will be necessary to attend driving courses and successfully obtain a motor vehicle driver's certificate in the exams.

For these individuals to start training at driving courses, the time that has passed since the date of the license cancellation must be equal to the revocation periods specified in the reasons for cancellation, all administrative fines imposed under the law must be collected, drivers must pass the psychotechnical evaluation, and it will be mandatory to present a health board report from official health institutions showing that there is no obstacle to driving.

FINES WILL BE IMPOSED IF THE DRIVER EXCEEDS THE DAILY VEHICLE USE TIME

The proposal amends the provision regarding the obligation to comply with vehicle use times in the Highway Traffic Law.

Accordingly, vehicles that are required to have and use a tachograph device cannot be used in violation of the vehicle use times and cannot be allowed to be used. The operator will be obliged to take necessary measures and conduct inspections to ensure that the vehicle is not used in violation of the provisions specified in the relevant regulation, regardless of whether the driver is the operator or not.

The vehicle use, break, and rest periods for those who will use these vehicles, the cases where more than one driver must be assigned to the vehicle, the time interval during which drivers must be present in the vehicle, the responsibilities of the operators, and the procedures and principles to be applied in inspections will be determined in the regulation.

If the specified daily continuous vehicle use time is exceeded by up to one hour, a fine of 1,000 lira will be imposed on the driver; if it is exceeded by more than one hour, the fine will be 3,000 lira; if the total daily vehicle use time is exceeded by up to one hour, the fine will be 3,000 lira; if it is exceeded by one hour to three hours, the fine will be 5,000 lira; and if it is exceeded by three hours or more, the fine will be 10,000 lira.

If the weekly or combined two-week vehicle use time is exceeded by up to four hours, a fine of 10,000 lira will be imposed; if it is exceeded by four hours to 15 hours, the fine will be 15,000 lira; if it is exceeded by 15 hours or more, the fine will be 20,000 lira; if daily rest periods are violated, a fine of 3,000 lira will be imposed; and if weekly rest periods are violated, a fine of 5,000 lira will be imposed.

If the driver is also the operator, the administrative fines will be applied at double the rate. If the driver is not also the operator, administrative fines will be applied at double the rate to the operator who fails to fulfill their responsibilities. In cases where more than one driver is required to be assigned to operate the vehicle, an administrative fine of 10,000 lira will be imposed on the operator who does not comply with the relevant provisions regarding the drivers who must be present in the vehicle.

SPEED LIMIT REGULATION

With the proposal, a change is being made to the provision regarding the obligation to comply with speed limits in the Highway Traffic Law. Accordingly, drivers will not exceed the speed limits specified in the regulation unless a contrary decision is made and marked.

As a result of detection made by speed measuring technical devices or various technical methods, those exceeding the speed limits specified in the regulation within residential areas by 6-10 kilometers/hour will be fined 2,000 lira, those exceeding by 11-15 kilometers/hour will be fined 4,000 lira, those exceeding by 16-20 kilometers/hour will be fined 6,000 lira, those exceeding by 21-25 kilometers/hour will be fined 8,000 lira, those exceeding by 26-35 kilometers/hour will be fined 12,000 lira, those exceeding by 36-45 kilometers/hour will be fined 15,000 lira, those exceeding by 46-55 kilometers/hour will be fined 20,000 lira, those exceeding by 56-65 kilometers/hour will be fined 25,000 lira, and those exceeding 66 kilometers/hour or more will be fined 30,000 lira as an administrative fine.

For the mentioned speed limits, those exceeding by 11-15 kilometers/hour outside residential areas will be fined 2,000 lira, those exceeding by 16-20 kilometers/hour will be fined 4,000 lira, those exceeding by 21-25 kilometers/hour will be fined 6,000 lira, those exceeding by 26-30 kilometers/hour will be fined 8,000 lira, those exceeding by 31-40 kilometers/hour will be fined 12,000 lira, those exceeding by 41-50 kilometers/hour will be fined 15,000 lira, those exceeding by 51-60 kilometers/hour will be fined 20,000 lira, those exceeding by 61-70 kilometers/hour will be fined 25,000 lira, and those exceeding 71 kilometers/hour or more will be fined 30,000 lira as an administrative fine.

Those who violate the speed limit within residential areas by 46-55 kilometers/hour will have their driver's licenses revoked for 30 days each time, those violating by 56-65 kilometers/hour will have their licenses revoked for 60 days each time, and those violating by more than 66 kilometers/hour will have their licenses revoked for 90 days each time.

With the accepted proposal of the AK Party in the General Assembly, the location of inspections to be conducted in residential areas with a population of less than 5,000 will be determined by the local administrative authority.

Those who exceed the speed limit outside residential areas by 51-60 kilometers/hour will have their driver's licenses revoked for 30 days each time, those exceeding by 61-70 kilometers/hour will have their licenses revoked for 60 days each time, and those exceeding by more than 71 kilometers/hour will have their licenses revoked for 90 days each time.

In order for the revoked driver's licenses to be returned, all administrative fines imposed must be collected. Additionally, driver's licenses that have been revoked for the fifth time within one year from the date of the last violation will be returned at the end of the revocation period, provided that it is understood that there is no obstacle to obtaining a driver's license after undergoing a psychotechnical evaluation and examination by a psychiatry specialist.

The manufacturing, importation, and possession of any devices used to detect whether speed limits are exceeded or to warn drivers will be prohibited. Those who manufacture and import these devices will be fined 370,000 lira, even if the act constitutes another crime, and operators who possess these devices in their vehicles will be fined 185,000 lira. Additionally, these devices will be confiscated by the local authority, and it will be decided to transfer their ownership to the public. This provision will come into effect on December 31, 2025.

VEHICLES WITH RIGHT OF WAY

With the regulation, a fine of 15,000 lira will be imposed on drivers who do not give way to vehicles belonging to law enforcement officers following a convict or suspect, vehicles going to the scene of an incident urgently to maintain public safety, vehicles belonging to officials going to the scene of an incident or accident to protect traffic safety or seize a traffic accident, vehicles assigned to disaster and emergency services in cases of disaster and emergency, and vehicles belonging to the upper authorities of the legislative, executive, and judicial branches of the state as specified in the regulation.

Drivers who do not clear the way for ambulances, vehicles carrying injured or emergency patients, and vehicles fighting forest fires upon receiving audible or visible signals will be fined 46,000 lira, their driver's licenses will be revoked for 30 days, and their vehicles will be banned from traffic for 30 days.

Driver's licenses that are revoked for the second time within 5 years under this provision will be canceled. Those whose driver's licenses are canceled will be required to attend driving courses and successfully obtain a motor vehicle driver's certificate in the exams to be able to obtain a driver's license again.

In order for these individuals to start training at driving courses, it will be mandatory that the time elapsed since the date of revocation is equal to the duration of the revocation stated in the reasons for revocation, all administrative fines imposed have been collected, and a document showing that there is no obstacle to driving as a result of the psychotechnical evaluation to which they will be subjected is presented to the driving course.

With the regulation, a change is being made to the provision in the Highway Traffic Law regarding "Lane monitoring, encountering oncoming traffic, distance between vehicles, driving slowly, and facilitating passage."

In this context, drivers who do not comply with the distance rule between vehicles will be fined 5,000 lira; drivers who do not comply with the other rules of the provision will be fined 1,000 lira as an administrative fine.

Drivers who do not comply with the provisions regarding right of way at intersections will be fined between 1,000 lira and 5,000 lira.

On the other hand, a decision was made by the Advisory Board not to hold the General Assembly today and tomorrow.

After the acceptance of Article 17, Deputy Speaker of the Grand National Assembly of Turkey Pervin Buldan adjourned the meeting. After the break, as the commission did not take its place, Buldan closed the meeting to reconvene on Tuesday, January 20 at 15:00.
