2.5 billion lira inheritance case: Precautions should be taken at the cemetery!

04.09.2024 16:22

A dispute over a 2.5 billion lira inheritance has arisen in the Selvili family, one of the well-known families in Izmir. Esen Gül Berker, claiming to be one of the heirs, filed a lawsuit. Berker's attorney requested precautionary measures, stating that they suspect the possibility of altering the graves from which DNA samples will be taken for possible exhumation.

In 1916, Mehmet Selvili, the eldest of the well-known Selvili family from İzmir, who came to Turkey from the city of İskeçe in Greece, brought Hilmi, the eldest of his 6 children named Hilmi, Mustafa, Emine, Seher, Hakkı, and Osman Nuri, who lived in Greece. Later, when the other 5 children also came to the country, it is claimed that the children were not registered under their father Mehmet Selvili's population. After Mehmet Selvili passed away, all his inheritance was left to his registered heir Hilmi Selvili. While the other 5 children of Mehmet Selvili lost their lives at different intervals, 4 of these 5 children did not leave behind an heir.

"HE IS NOT OUR UNCLE OSMAN NURI SELVİLİ"

Esen Gül Selvili Berker, who was adopted by Osman Nuri Selvili, one of Mehmet Selvili's sons, in 1980, filed a lawsuit through her lawyer Hüseyin Ercüment Değer in January, claiming her father's rights. The lawsuit, which will determine the approximately 2.5 billion lira inheritance, including plazas and other immovable properties in İzmir and Çeşme, started to be heard today in the 13th Civil Court of First Instance in İzmir. After the second hearing, the opposing party claimed that Osman Nuri Selvili was not their uncles. Lawyer Hüseyin Ercüment Değer stated that both in death announcements and in family photos, Osman Nuri Selvili was with his other siblings and they frequently gathered together and continued their family unity until their last day. In the decision given in this hearing, the judge decided to apply the conquest of the grave process in the graves of Hilmi Selvili, Mustafa Selvili, and Osman Nuri Selvili. However, a few days before the exhumation of the graves and taking DNA samples, the current heirs of the Selvili family, including Zeynep Selvili, objected to the situation. Upon the objection, the court allowed them to make a statement until the new session.

"WE HAVE DOUBTS ABOUT CHANGING THE GRAVE SITE"

The new session regarding the lawsuit was held today. Esen Gül Selvili Berker, along with the lawyers of both parties, attended the trial, and the first word was given to Lawyer Hüseyin Ercüment Değer. Değer said, "I want to ask the heirs of Hilmi Selvili if they accept that Osman Nuri Selvili is Hilmi Selvili's brother." In response, the representative of Hilmi Selvili's heirs replied, "Hilmi Selvili does not have a brother named Osman Nuri." Upon this, the judge sent the request for the rejection of the judge to the higher court to be decided. In the session, the plaintiff's representative expressed doubts about changing the burial place of Hilmi Selvili and Osman Nuri Selvili and requested precautions to be taken in the graves. The representative of Hilmi Selvili's heirs objected to the request, saying, "It is not possible to move the burial place. The suspicion is unfounded." Continuing the interim decision, the judge decided that there was no need for any action at this stage and adjourned the case.
