Fatma E., who caused the death of Kazakhstan citizen Aliya Kulmagambetova by hitting her with her car while she was trying to cross the road at a pedestrian crossing in Antalya two years ago, was sentenced to 2 years and 1 month in prison. The court converted Fatma E.'s prison sentence, which was found to be 100% her fault in the reports, into a fine of 30,400 Turkish lira, ruling that it should be paid in 10 installments.
Two years ago, Kazakhstan's Aliya Kulmagambetova, who came to Alanya for vacation, was hit by a car with the license plate 07 BDV 357 driven by Fatma E. Despite the doctors' efforts, Aliya Kulmagambetova, who was seriously injured, lost her life.
'THERE WAS A HEADPHONE' CLAIM Driver Fatma E. was taken to the police station for questioning after the investigation at the accident site. In her statement, Fatma E. said that Kulmagambetova was trying to cross the street, that she honked to warn her, but she didn't hear it because she had headphones on, and that she pressed the brake but the vehicle did not stop. After her statement, Fatma E. was released, while Aliya Kulmagambetova's body was sent to Kazakhstan.
48 METERS OF BRAKE MARKS During the investigation at the accident site, it was determined that there were 48 meters of brake marks belonging to the vehicle driven by Fatma E. The expert report stated that Kulmagambetova was faultless, while driver Fatma E. was fully at fault. In her statement at the first hearing, Aliya Kulmagambetova's mother, Dariga Daumbayevna, said that she wanted to forgive Fatma E. but that she had not even called to express her condolences, and instead, she published videos of herself having fun on social media about 10 days after the incident, asking for her to be punished. The family's lawyer, Ali Şan, requested that no reduction be made in the penalty given to Fatma E.
CONVERTED TO A FINE The Alanya 7th Criminal Court, where the case has been ongoing for 2 years, made a decision in the last hearing. The court sentenced Fatma E. to 2 years and 6 months in prison for 'causing death by negligence', reducing the sentence to 2 years and 1 month, converting the sentence to a judicial fine of 30 thousand 400 lira, and confiscating her driver's license for 4 months. It was ruled that the 30 thousand 400 lira fine given to Fatma E. would be paid in 10 installments. Kulmagambetova's family stated that they would appeal the decision.
EXPERT REPORT STATES "FAULTLESS" Ali Şan, the lawyer for Kulmagambetova's family, stated, "In both the investigation and prosecution stages, the expert reports indicate that the deceased had no fault, and all the fault lies with the driver, that is, the defendant. The trial was conducted, and all evidence was collected." Şan, who said that the sentence saddened the family, added, "The penalty given for a person's life is 30 thousand 400 TL. We did not know how to explain this decision to the family. The family is currently in shock. This incident is also being monitored by the Kazakhstan Consulate. The saddest part is that despite the trial lasting nearly 2 years, during this time, the defendant not only did not express condolences to the family but also conducted live broadcasts on various social media platforms about 10 days after Kulmagambetova's death. We reported this to the court, shared video footage, and stated that mitigating circumstances should not be applied in this concrete case, yet unfortunately, a monetary fine was imposed as a result of the trial," he said.
"A DECISION WITHOUT PRECEDENT" Ali Şan, who stated that they would appeal the decision, said, "As far as I know, this is a decision without precedent, as in practice, at least 2 to 3 years of imprisonment is given in such cases. We are currently waiting for the reasoned decision to be written. After it is written, we will make our appeal. We hope that this decision will be overturned. We believe that a person's life should not be valued at 30 thousand 400 TL," he expressed.
"30 THOUSAND 400 TL WAS PLACED ON A PERSON'S LIFE" Dariga Daumbayevna, the mother of the deceased woman, said, "I do not want anyone to experience such pain, to lose a child because of someone else. We were even ready to forgive the perpetrator, but we just buried our daughter, and 10 days later, she shared a video of herself having fun and singing. There is no sign of remorse here. During the 2-year trial process, condolences were never conveyed to us from the guilty side," she said.
Daumbayevna, who stated that they were expecting a fair decision, said, "A 2.5-year prison sentence was given for the killing of a cat, but a person's life was valued at 30 thousand 400 TL. We will appeal for the case to be re-examined. We are waiting and hoping for a fair decision," she concluded.
