In the case regarding the collapse of the Ergün Apartment, where 27 people lost their lives and 21 were injured in the Kahramanmaraş-centered earthquakes that occurred on February 6, 2023, in Malatya, a verdict was announced for 10 defendants who are being tried without detention. While the technical responsible person and the contractor were arrested, 3 defendants were acquitted.
In the case of the Ergün Apartment, which was destroyed by the earthquakes centered in Kahramanmaraş, the prosecutor requested the court to punish the defendants for "causing the death and injury of multiple people with conscious negligence" and to have them arrested along with the verdict. The defendants, who did not accept the charges against them, requested acquittal. Some defendants and the attorneys of the parties attended the hearing at the 2nd Heavy Penal Court.
THEY REQUESTED ACQUITTAL
The defense attorneys presented documents to the court indicating that after the earthquake centered in Elazığ in 2020, the Provincial Directorate of Environment and Urbanization sent a list of damaged buildings to the district municipality and the district governorate. The defense attorneys stated that the Ergün Apartment was among the damaged buildings and that the causal link for their clients had been severed, requesting their acquittal.
2 DEFENDANTS WERE ARRESTED, 3 WERE ACQUITTED
The court panel sentenced the contractor I.G. and the technical responsible B.B. to 13 years and 6 months in prison, issued an arrest warrant along with the verdict, sentenced the municipal officials of the time B.S. and D.Ö. and A.Ö. to 8 years, 10 months, and 20 days in prison, and postponed the announcement of the verdict. It sentenced B.Ö. to 13 years and 9 months, and Y.E. to 11 years, 9 months, and 20 days in prison, and postponed the announcement of the verdict.
The panel decided to acquit the defendants M.G, B.A., and H.A.
Defendant B.B, who was present in the courtroom, was arrested after the reading of the decision.
