Mükremin Gezgin, whose video aimed at children featuring the phrase "I am a woman" became a topic of discussion, was acquitted in a case where he was charged with 'obscenity.' In the case initiated by the Family Ministry's complaint, the prosecutor stated that there was no evidence of a crime. Gezgin argued that the video was humorous and a form of self-expression.
The Ministry of Family and Social Services filed a criminal complaint against the phenomenon Mükremin Gezgin after he shared videos on social media asking boys, 'Aren't I a woman?' The complaint was based on charges of 'indecent behavior' and 'obscenity.' As part of the investigation initiated by the Ankara Chief Public Prosecutor's Office, Gezgin was detained in Ankara and was sentenced to house arrest for the crime of 'obscenity' by the court he was brought before in April.
"CAN HAVE A NEGATIVE IMPACT ON CHILDREN"
In the indictment prepared by the Ankara Chief Public Prosecutor's Office, it was stated that an investigation was conducted following the complaint from the Ministry of Family and Social Services, and that Gezgin published a video on his Instagram account '@mukremingezgin,' in which he engaged in obscene behavior, and that the spread of these images on social media could have a negative impact on children. The indictment described that upon examining the video, it was noted that the lower part of the vest tied at Gezgin's waist was pulled up, exposing his hip area, and that he walked while shaking his hips. It was mentioned that during this time, he said some words to those around him, that children's voices were heard, and that he placed his hand on the shoulders of children while saying, 'Calm down, my dear,' and used expressions like, 'Aren't I a woman, I am a woman, I am a woman.'
REQUEST FOR 3 YEARS IN PRISON
In his defense included in the indictment, Gezgin stated that his followers often asked him, 'Are you a woman?' and that he made videos asking, 'Am I a woman?' He explained that due to the clothes he wore on the day of the incident, his hip area swayed involuntarily, that he tied his vest before encountering the children, and that the content did not contain any sexual innuendo directed at children. He stated that there was no intention of obscenity in the video recordings and that he would be more careful in the content he shared involving children. It was noted that Gezgin designed his clothing and walking to emphasize his hip area and that he shared these images on social media in a planned manner. For these reasons, it was stated that there was sufficient evidence to open a public case against him for 'facilitating the publication of obscene broadcasts.' The indictment requested that the defendant be sentenced to up to 3 years in prison.
"HIS ACTIONS ARE ARTISTIC IN NATURE"
In the first hearing of the case opened at the Ankara 42nd Criminal Court of First Instance, the defendant Mükremin Gezgin and his lawyer Elif Narin Dursun were present. In her defense, lawyer Dursun stated, "My client was spontaneously joined by children while filming a video in the market that day. He shares videos filmed in places like markets, streets, and homes. The video in question does not violate public morality, nor does it contain sexual content. In fact, my client's actions are artistic in nature. My client is being ironic, and citizens are laughing at this. This is a comedy. It should be evaluated as we have seen before in Huysuz Virjin. As stated in the Supreme Court decisions, mere exposure is not sufficient; this behavior must be done with a sexual motive. Therefore, we request his acquittal."
THE LEGAL ELEMENTS OF THE CRIME WERE NOT ESTABLISHED
The prosecutor stated in his opinion that it was understood that the legal elements of the crime were not established and requested acquittal. Defendant Mükremin Gezgin said, "I accept the opinion. I feel like a woman, and I feel good when I say this. In the images and throughout the video, I say, 'I am a woman.' There is no video that was specifically filmed on the day of the incident. The clothes I am wearing are what I always wear. I request my acquittal." The court acquitted Mükremin Gezgin on the grounds that the legal elements of the crime were not established.
