New developments are taking place in the 'fund' case that has hit Turkey's agenda like a bomb. The lawyers of Seçil Erzan, the former Denizbank branch manager who is being tried in detention for allegedly defrauding many individuals, including prominent figures in the football world such as Fatih Terim, Arda Turan, Fernando Muslera, and Emre Belözoğlu, submitted a petition to the Istanbul 41st Heavy Penal Court after the indictment against Denizbank General Manager Hakan Ateş and Mehmet Aydoğdu was returned. In the petition, it was requested that Erzan be released, or if that is not possible, to be released on bail or placed under house arrest. The indictment prepared by the Istanbul Chief Public Prosecutor's Office against Denizbank General Manager Hakan Ateş and Deputy General Manager Mehmet Aydoğan, on the grounds that they committed the crime of 'qualified fraud', was not accepted by the court. The court stated that there were deficiencies in the indictment. ATTENTION TO DEFICIENCIESThe justification noted that there was no mention of the actions of the suspects, how they committed the alleged "qualified fraud" against which complainant, and there were no elements in the indictment regarding what fraudulent behaviors the suspects used to gain benefits from whom and how much. It was also emphasized in the court's justification that there was no finding regarding how the defendant Seçil Erzan, whose trial is ongoing, participated with the two suspects mentioned in the indictment. It was pointed out that the damages of the complainants should have been clarified by questioning them, but there were deficiencies in the indictment in this regard. The court returned the indictment, which it did not accept for these reasons, to the prosecutor's office. THEY REQUESTED THE RELEASE OF SEÇİL ERZANAccording to T24's news, following the decision, Seçil Erzan's lawyers, Dağhan Ali Özel and Gökçenur Budak, submitted a petition to the Istanbul 41st Heavy Penal Court for the release of their client. The petition stated that it was unlawful for Erzan to be held in prison for 20 months while the indictment against Ateş and Aydoğdu was being returned. The petition included the following statements: My client is the only detained defendant in a case where multiple defendants are being tried. Due to the fact that many of the complainants and participants mentioned in the trial are famous football players and coaches, a sensational environment has been created in the public through the press and social media, and my client has been targeted. Considering the impact of this sensational environment, it is also clearly unlawful to decide to continue my client's detention without taking into account the 20 months spent in detention. Erzan's lawyers requested the release of their client, or if that is not possible, to be released on bail or placed under house arrest.
