An investigation has been initiated against Fatih Kapan, the judge of the Istanbul 8th Criminal Court of First Instance, who issued a release order for Emine Ayşe Barım, arrested as part of the Gezi Park investigation, and this decision was overturned by the chief public prosecutor's office within 4 minutes.
The manager Emine Ayşe Barım, who was arrested as part of an investigation regarding allegations in the written and visual media about her participation in the events centered around Gezi Park in Taksim, had her lawyers file an objection to her detention at the peace criminal court.
The court, which evaluated the request, rejected the objection and decided to continue Barım's detention. Following this, Barım's lawyer filed a new objection to her detention at the Istanbul 8th Criminal Court of First Instance.
THE JUDGE ISSUED A RELEASE ORDER
The judge Fatih Kapan, who evaluated the objection, stated that "the nature and characteristics of the crime attributed to the suspect, the witness statements in favor of her, the phone call recordings against her, and all evidence indicate that there is a possibility of change in the crime, and in this case, the detention decision would not be proportionate," and issued a release order.
AN INVESTIGATION HAS BEEN INITIATED AGAINST THE JUDGE
In response, the Istanbul Chief Public Prosecutor's Office objected to the decision before Barım's release was executed. The Heavy Penal Court, which found the prosecutor's request valid, issued a new arrest warrant for Barım.
The First Chamber of the HSK (Supreme Council of Judges and Prosecutors) initiated an examination and investigation against Judge Kapan, who issued the release order.
The Chamber ruled that the situation regarding the allegations in the notification and accompanying documents against Kapan, as well as other issues that may arise during the examination, should be examined by the council inspector, and if evidence is obtained, a formal investigation should be initiated.
WHAT HAPPENED?
Ayşe Barım, who was subjected to an investigation initiated by the Istanbul Chief Public Prosecutor's Office based on allegations in the written and visual media regarding her participation in the events centered around Gezi Park in Taksim, was arrested for "aiding and abetting an attempt to overthrow the Government of the Republic of Turkey or prevent it from performing its duties."
In the investigation, it was noted that in the content of a tape regarding a conversation between the fugitive defendant Memet Ali Alabora and another person, there was an exchange of ideas about publishing a statement with artists in Gezi Park during the events centered around Gezi Park, and it was confirmed that this was implemented.
It was stated that Barım had intense communication with the defendants of the Gezi Park case, Osman Kavala, Çiğdem Utku Mater, and Memet Ali Alabora, and that she directed the artists she managed to participate in the Gezi Park events, and that she herself participated in the events with these actors.
FALSE WITNESS INVESTIGATION
Additionally, within the scope of the investigation, actors Halit Ergenç, Bergüzar Korel, Mehmet Günsür, Ceyda Düvenci, Nejat İşler, Rıza Kocaoğlu, and Nehir Erdoğan were questioned as "witnesses."
In the dispatch letter sent by the prosecutor's office to the on-duty judge regarding Ayşe Barım's arrest request, it was stated that due to Ergenç and Kocaoğlu's claims of not being in contact with Alabora despite having images of them acting together during the events, an additional investigation was initiated for "false testimony."
ALLEGATIONS OF MONOPOLIZATION
Ayşe Barım, who is the founder and partner of ID Consulting Limited Company and also manages many famous actors, has been in the spotlight due to allegations of causing monopolization in the industry, with claims that Barım has sidelined actors who opposed her.
Additionally, an investigation is being conducted by the Istanbul Chief Public Prosecutor's Office regarding these allegations.
