The Constitutional Court (CC), made a striking decision regarding TİP Deputy Can Atalay, who was sentenced to 18 years in prison in the Gezi Park Case. The CC decided that the revocation of Atalay's parliamentary membership is null and void. STATEMENT FROM ÖZGÜR ÖZELCHP Chairman Özgür Özel, after the publication of the CC's decision in the Official Gazette stating that Can Atalay's parliamentary membership revocation is null and void, made a statement from his X account saying "Can Atalay should be released, he should be quickly sworn in as a member of parliament, and all his rights should be restored." Özel, drawing attention to the CC's decision that "the revocation of parliamentary membership is null and void," made the following statement; "The Constitutional Court has determined with its reasoned decision regarding Hatay Deputy Can Atalay that the revocation of his parliamentary membership is null and void. Can Atalay should be released, he should be quickly sworn in as a member of parliament, and all his rights should be restored." WHAT HAPPENED?Istanbul 13th Heavy Penal Court had sentenced Atalay to 18 years in prison for "attempting to overthrow the Government of the Republic of Turkey" and ordered his arrest. Istanbul Regional Court of Justice had found the local court's decision to be in accordance with the law. Can Atalay, who was elected as a TİP Deputy from Hatay in the 28th General Election, had applied to the Court of Cassation, and while the process was ongoing, the 3rd Criminal Chamber of the Court of Cassation had upheld the 18-year prison sentence given to Can Atalay in the Gezi Park Case. After the Court of Cassation's rejection of the request, Atalay had applied to the Constitutional Court twice, and in both applications, the Constitutional Court had ruled that there was a violation of rights. The 3rd Criminal Chamber of the Court of Cassation had ruled that there was no need to comply with the Constitutional Court's decisions regarding Atalay's rights violation and ordered the decision to be sent to the Presidency of the Grand National Assembly. Meanwhile, with the revocation of Can Atalay's parliamentary membership, TİP's number of seats in the Parliament decreased from 4 to 3.
