Controversy in the Sinan Ateş case! The judge wanted to remove Ayşe Ateş's lawyer from the courtroom.

In the ongoing second hearing of the Sinan Ateş case, National Path Party Chairman Remzi Çayır was removed from the courtroom due to his reaction to the behavior of one of the lawyers and the presiding judge during a dispute between the lawyers. Prior to the argument, the detained defendant and MHP lawyer Serdar Öktem, who was giving his defense, said, "I think that the prosecutors Durmuş Ali Kaya and Durdu Özer manipulated the incident to target a community. The first question I was asked was 'Are you a member of MHP?'". The defense of the defendants in the Sinan Ateş case is ongoing.

MHP LAWYER: EVERY TERRORIST HAS MADE NEWS ABOUT ME

In the second day of the trial at the 32nd Heavy Penal Court in Ankara, MHP lawyer Serdar Öktem, who is being tried for "assisting in the deliberate killing of Sinan Ateş collectively and in complicity", said, "On the first day of my arrest, I gave a statement at the Public Prosecutor's Office. I think that the prosecutors Durmuş Ali Kaya and Durdu Özer manipulated the incident to target a community. The first question I was asked was 'Are you a member of MHP?'. I asked, 'Yes, I am a member of MHP, which I am proud of with honor and dignity, but what does that have to do with anything?' Cevheri Güven, who is being tried as a traitor, made 3 videos about me. It is being written and drawn on social media. FETÖ members, DHKP-C members, PKK members wrote that I was detained, every terrorist made news about me. I wanted to go to the police because I was uncomfortable with these.

"PROSECUTORS DURDU ÖZER AND DURMUŞ ALİ KAYA DID NOT ACT AS PROSECUTORS, THEY ACTED AS ACCUSERS"

Öktem continued his defense as follows; "I arrived at the main entrance of the police station. Rumors spread that I was detained at the Homicide Bureau. I came to give a statement. The police officer at the entrance called the Homicide Bureau and said that there was no such instruction about me. I have been shouting for 16 months. Bring my call records, it will be determined that I was in Istanbul. I was asked why I met with Ufuk Köktürk. We have a lawyer-client relationship. He asks about my well-being, asks legal questions, and I answer them. I gave a statement and made a defense within 3 minutes, and then an arrest warrant was issued against me. It is impossible to prepare this in such a short time. I did not encounter any mistreatment at Ankara Police Department. I insistently said that there is a malicious intent here. If I met with my clients because of my profession, is this a crime? I was held inside with the statements of terrorists and traitors on social media. Prosecutors Durdu Özer and Durmuş Ali Kaya did not act as prosecutors, they acted as accusers. I have full confidence that I will be acquitted as a result of the trial. I demand to be released and then acquitted after the trial."

Defendant Serdar Öktem stated that he could not provide his phone password because he forgot it, and he stated that even if he remembered it, he would not give it according to Article 36 of the Lawyers' Act. Upon this, Şeyda Şahin, one of the plaintiff's lawyers, said, "If he gives this password, the relevant parts related to our case can be extracted". There were mutual arguments between the plaintiff's lawyers and the defendant's lawyers. The plaintiff's lawyers expressed their reaction by hitting the tables.

"YOU ARE MAKING ME SHOUT HERE"

The presiding judge said that if the plaintiff's lawyers continue to react, they will be removed from the courtroom, and asked for the removal of Ayşe Ateş' lawyer Ali Yücel by the law enforcement officers. In response, the lawyers continued to show their reaction to the presiding judge and removed one lawyer and National Path Party Chairman Remzi Çayır from the courtroom. The presiding judge also stated that some law enforcement officers were not doing their duty and said, "You are making me shout here. Why aren't you doing your duty? I am the one giving the instructions. Why aren't you implementing them? I will prepare a report about the police officers who are not performing their duties". After the tension, the questions to Serdar Öktem from the lawyers continued. Then, the hearing was adjourned until 14.00.
