The Consumer Arbitration Board in Konya evaluated the application made by a person who sells automotive spare parts, requesting a refund of 128.18 TL that was charged to his credit card for the vehicle inspection fee at the car inspection station. The Board decided to accept the applicant's request for a refund and classified the difference charged by the company to his credit card as 'defective service'.
Hüseyin Özdemir (34), who sells automotive spare parts, took his car to the vehicle inspection station in Seydişehir district on December 28, 2023 for visa procedures. Özdemir paid the visa processing fee of 1130.44 TL with his credit card and paid an additional 128.18 TL. After sharing the situation with his lawyer Emre Akman, Özdemir applied to the Consumer Arbitration Board on February 7 for the refund of the 128.18 TL, when he learned that the 128.18 TL difference was against the Law on the Protection of Consumers.
REFUND DECISION FOR THE CHARGED DIFFERENCE
The Consumer Arbitration Board, which evaluated the application, decided to refund the charged difference to the credit card. The Board described the difference charged to the credit card by the company as 'defective service' in its justification.
"THE GOAL IS NOT 128 TL"
Hüseyin Özdemir, who won the legal battle, stated that his goal was not to get back the 128.18 TL, saying, "I filed a complaint for awareness on this issue. As a result, my complaint has been resolved and we won. The aim here is not 128 TL. I want people to demand their rights. I became a role model for millions of people and set an example for the removal of this difference taken from millions of people in Turkey. The goal here is not 128 TL. "A PRECEDENT DECISION"
Hüseyin Özdemir's lawyer said, "When my client went for the inspection of his vehicle and chose the credit card payment option, an additional 128.18 TL balance appeared on top of the amount my client had to pay. Upon the request of my client, we applied to the Consumer Arbitration Board. Our application was recently reviewed and it was decided to refund the 128.18 TL, which was collected by the company, according to the 'defective service' article in the Law on the Protection of Consumers. When we look at it, tens of thousands of people come to the vehicle inspection station to have their vehicles inspected. People also want to make payments with their credit cards. If 128.18 TL is collected from each person's credit card, this would amount to millions of TL daily. This is a decision that is considered as a defective service in the consumer law. This is a precedent decision. When our client receives 128.18 TL, he will neither become rich nor poor. Our only aim here is to inform the public. People who want to get back the amount charged at the vehicle inspection station can refer to our decision as a precedent. We want our citizens to be informed that the commission charged to the credit card by the company is definitely against the law" he said.
