Hülya Ö., who caused the death of Sezin Sezgin by hitting her with her car while she was trying to cross the road in Samsun, was sentenced to a judicial fine of 8,700 lira, to be paid in 4 installments, for insulting Sezin's mother, Ece Sezgin, at the accident scene. The court postponed the announcement of the verdict. The case against Hülya Ö. for the charge of 'causing death by negligence' is still ongoing.
The accident occurred on December 10, 2024, in the Çay neighborhood of Çarşamba district on Mustafa Kemal Güneşdoğdu Street. Sezin Sezgin, who wanted to cross the road after leaving a café to retrieve her mother's phone from the car, was hit by a vehicle with license plate 34 PD 5421 driven by Hülya Ö., who was driving with her two children. Upon notification, police and medical teams were dispatched to the scene. The teams determined that Sezin Sezgin had lost her life. The accident was captured by the security camera of a business.
After the incident, Hülya Ö. was taken into custody and stated in her testimony, "As far as I remember, my vehicle was going at a speed of 45-50 kilometers. I have been driving for 1 year actively. I obtained my driver's license about a year ago. I have a learner's permit. I saw someone jump in front of me, but I didn't realize it was a child. The impact caused the girl to be thrown forward." After her procedures, Hülya Ö. was brought to court, where she was placed under house arrest. Additionally, moments when Hülya Ö. told mother Ece Sezgin, 'You should have taken care of your child,' were recorded by a nearby person using a mobile phone camera.
INDICTMENT PREPARED
The Çarşamba Chief Public Prosecutor's Office prepared an indictment against Hülya Ö. for the crime of 'causing death by negligence.' The indictment was accepted by the Çarşamba 6th Criminal Court of First Instance. The expert report included in the indictment stated that although pedestrian Sezin Sezgin was at fault for stepping onto the road without checking, driver Hülya Ö. hit her while approaching the pedestrian refuge, passing over the pedestrian with her left two tires, and did not take actions such as braking and maneuvering to prevent the severity of the accident from increasing. The report also indicated that Hülya Ö. was found at fault for behaving carelessly and recklessly, not reducing her speed sufficiently, and not considering the conditions required by traffic.
HOUSE ARREST SENTENCE LIFTED
In the 'causing death by negligence' case held on April 10, Hülya Ö. defended herself, saying, "I am a mother too. I was driving, I wasn't going fast. Something jumped in front of me, but I didn't see what it was. After getting out of the vehicle, I realized I had hit the child. There was no visibility. I didn't have the opportunity to brake in time. I didn't leave the scene after the accident, and I am very sorry for what happened." After listening to the defendant and witnesses, the court lifted the house arrest and electronic bracelet decision given to the defendant and decided to apply judicial control measures, postponing the hearing.
A LAWSUIT FOR 'INSULT' WAS ALSO FILED
Ece Sezgin reported to the Çarşamba Chief Public Prosecutor's Office, claiming that Hülya Ö. insulted her during the incident. As a result of the investigation conducted by the prosecutor's office, an indictment was prepared against Hülya Ö. for the crime of 'insult' on March 6. The indictment, which sought a prison sentence of up to 2 years for Hülya Ö., was accepted by the Çarşamba Criminal Court of First Instance.
The indictment stated, "In the expert examination of the existing camera footage related to the incident, it was determined that the complainant Ece Sezgin said, 'How did you hit?' and the suspect Hülya, with aggressive behavior, stood up and said, 'If you had taken care of your child, you idiot, your child jumped in front of me,' thus committing the public insult crime attributed to her."
THE DEFENDANT WAS FINED 8,700 LIRA
In the first hearing of the 'Insult' case held on June 27, the prosecutor presented his opinion. The prosecutor requested that the defendant be punished for 'public insult' due to the fact that the insult was made in a way that multiple people in a public place could hear. The decision hearing of the 'Insult' case was held on September 12. The court sentenced the defendant to a judicial fine of 8,700 lira to be paid in 4 installments. The court, considering the defendant's lack of a criminal record and the belief that she would not commit another crime, postponed the announcement of the verdict.
