Recep İnan in Bursa, shot and injured his enemy Hüseyin Çekçen, whom he learned had an argument with his father Ali İnan, on the passenger minibus he was riding. In the incident that took place in Mustafakemalpaşa district of Bursa, Recep İnan learned that his father Ali İnan had an argument with Hüseyin Çekçen, with whom they had a feud, and that Çekçen pushed his father, who had been punched by him. Recep İnan heard that Çekçen went to the terminal in the district to return to Bursa. İnan, who went to the terminal, saw Çekçen getting on the minibus. When Recep İnan saw himself, he shot Çekçen, who was hiding between the seats of the vehicle, among the passengers, including a baby, with a gun. Hüseyin Çekçen, who was hit on the head with the butt of the gun by Recep İnan, fell out of the minibus through the open door after receiving the blows. While Recep İnan continued to beat Hüseyin Çekçen there, his father Ali İnan also pulled out a knife.

Hüseyin Çekçen, who was seriously injured in the attack, was taken to the hospital for treatment, and the father and son who fled after the incident were caught and detained at their homes along with the gun used in the incident. The father and son were arrested by the court they were referred to. In his statement, Recep İnan said, "We had a fight with Hüseyin Çekçen 3 years ago. He beat me. My brother also beat him. Çekçen, who could not accept this, then injured my brother with a gun. We haven't seen each other since that day. He came to our neighborhood before the incident and spoke insultingly, saying 'I will shoot Recep too'. My father, who went to the bank to withdraw money on the day of the incident, met him on the way and punched him, saying 'Don't act like an artist'. He also pushed my father. My father came home and told me about this incident. I took the gun left by my grandfather and went to the terminal with my father. We saw him on the minibus. I shot to scare him. I had no idea that I hit him. Also, I did not hit him with the butt of the gun. It must have happened unintentionally during the fight," he said.

'I HID BETWEEN THE BACK SEATS OUT OF FEAR'

Hüseyin Çekçen, who was discharged from the hospital after a long treatment, said the following in his statement:

"I live in Osmangazi district of Bursa. I went to Mustafakemalpaşa district for my military affairs. On the way, I encountered Ali İnan. He attacked me and punched me. To prevent the incident from escalating, I moved away from there and was dropped off at the terminal by the police officers I requested. While waiting on the minibus, I saw Recep İnan coming to the minibus I boarded. I hid between the back seats out of fear. Recep İnan, who got on the vehicle, shot at my stomach. He hit me using the butt of the gun. I fell when the back door opened during the fight. He continued to beat me here as well."

PROSECUTOR REQUESTED PUNISHMENT FOR 'ATTEMPTED MURDER'

Ali İnan, who was seen taking a sharp object out of his pocket in the camera footage, denied the accusations. After the investigation, in which the camera footage was included as evidence, a trial was opened against Recep İnan and his father Ali İnan at Bursa 6th Heavy Penal Court. In the trial where Hüseyin Çekçen complained about the defendants, the detained defendants repeated their statements given during the investigation. The prosecutor, who gave his opinion at the first hearing, requested that Recep İnan and Ali İnan, whose guilt he found proven, be sentenced to up to 15 years in prison for the crime of 'attempted murder'.

'MISTAKES IN THE INDICTMENT'

Hakan Gündoğdu, the lawyer of Recep İnan, who made a defense in the trial, claimed that his client did not commit the act with the intention of killing and that the indictment was prepared incorrectly. Gündoğdu, who said that the incident occurred because the complainant, who injured his client's brother, came to the district, said, "Normally, these people live in very different places, but the person my client shot has been hanging around my client for a while. When his father saw this, he went home and told his family about the situation and warned them, saying 'Look, the person who injured your brother can harm us again'. My client and his father went to the terminal to see if he left the district. They saw him on the minibus. Then an argument broke out. There are some mistakes in the indictment, such as; when a distinction needs to be made between attempted murder or intentional injury, especially the decisions of the Court of Appeal and the Supreme Court say that 4-5 criteria should be considered. It should be examined whether there is a feud that would require killing, the location of the targeted area, the number of blows to the target area, and similar criteria," he said.

IT WAS CLAIMED THAT HE AIMED AT THE LEGS

Hakan Gündoğdu, who claimed that Recep İnan shot towards Hüseyin Çekçen's legs, but the bullet hit the complainant's abdomen due to the recoil of the gun, said, "The complainant has an injury. They missed this in the indictment; my client is held responsible for 'attempted murder' because of the bullet that hit the complainant's lower left abdomen. The gun has a recoil speed. You cannot directly shoot at the targeted area with a gun. Due to the recoil, it gains upward momentum. Although he aimed at his legs, it hit his lower left abdomen. We think that my client will receive a sentence for 'intentional injury under provocation' under the worst conditions," he said. The court adjourned the trial to make a decision and decided to continue the detention of the defendants.
