The 2nd Chamber of the Council of Judges and Prosecutors has rendered its decision regarding the disciplinary investigation conducted into judges and prosecutors involved in the judicial process known to the public as the "Ergenekon Case." As a result of the examination of 87 files, a total of 62 judges and prosecutors, including Hasan Hüseyin Özese, Sedat Sami Haşıloğlu, and Zekeriya Öz, were given the penalty of dismissal from the profession.
The 2nd Chamber of the Council of Judges and Prosecutors (HSK) announced its decision regarding the disciplinary investigation conducted against judges and prosecutors who took part in the investigation and prosecution stages of the judicial process known publicly as the "Ergenekon Case."
FINDINGS REGARDING THE RIGHT TO A FAIR TRIAL
In the evaluations of the HSK 2nd Chamber, it was stated that during the Ergenekon trial process, instead of reaching the material truth through legally obtained evidence, digital data proven to be fake by forensic and technical reports, files deemed to have been created through external interference, and controversial secret witness statements were taken as the basis for the verdict.
It was assessed that during this process, the presumption of innocence and the right not to be stigmatized of the defendants were violated; the defense's right of access to evidence was restricted; practices that hindered the exercise of the right to defense were employed; and the proceedings were steered through media operations in the public eye.
87 FILES EXAMINED
In the review conducted by the HSK 2nd Chamber, the acts in a total of 87 files were evaluated, including 240 allegations from 30 separate investigation files and 57 recourse files, among which are files resulting in Constitutional Court violation decisions.
As a result of the evaluation, a penalty of dismissal from the profession was imposed on 62 judges and prosecutors pursuant to the last paragraph of Article 69 of Law No. 2802 on Judges and Prosecutors.
A TOTAL OF 230 DISMISSAL PENALTIES IMPOSED
In the decision, multiple dismissal penalties were imposed separately on some individuals due to more than one act. It was decided to impose a dismissal penalty 19 times against Hasan Hüseyin Özese, 17 times against Sedat Sami Haşıloğlu, 16 times against Hüsnü Çalmuk, 13 times against Zekeriya Öz, and 12 times each against Mehmet Ali Pekgüzel and Ercan Fırat.
Additionally, a dismissal penalty was imposed 11 times against Nihat Taşkın, 10 times each against Fatih Mehmet Uslu, Mehmet Murat Dalkuş, and Nihat Topal, 7 times each against Fikret Seçen and Mehmet Murat Yönder, 6 times against Ercan Şafak, and 5 times against Metin Özçelik.
In total, it was decided to impose a dismissal penalty 230 times against 62 judges and prosecutors.
OTHER DECISIONS ALSO ANNOUNCED
The HSK 2nd Chamber also decided to discontinue the investigation files against Resul Çakır and Sadettin Avcı due to their deaths.
It was ruled that there was no need to impose a penalty regarding a total of 92 acts of 15 different individuals, and no need to decide on the duplicate acts of 21 individuals.
In the 57 recourse files subject to Constitutional Court violation decisions and compensation rulings by heavy penal courts, it was decided to permit the recourse of compensations paid by the Treasury to the relevant individuals.
