The previous situation was as follows; if a Mayor is removed from office or resigns, the Municipal Council elects one of its members as the deputy mayor. This was the correct method according to us. However, the government has a defense, a statement; 'If someone from the Municipal Council is elected there, the same system will continue. Why are we removing them from office? Because they are channeling resources to terrorism.' However, it should also be noted that none of the investigations regarding these individuals are due to channeling resources to a terrorist organization. They are accused of being members of a terrorist organization or of making propaganda for a terrorist organization for different reasons. Okay, this is in accordance with the definition in the law. When they are removed from office, it is legal for the Interior Ministry to intervene and appoint someone there, but we say that since those individuals are elected to that position, but it is claimed that they are doing things that are not required of that position, they are being tried and perhaps convicted. Therefore, there is still an elected council in that municipality. They can elect one of their own. It is not necessary to make an appointment from Ankara. This is what we believe is correct." he said.

"IT IS WRONG TO INSIST ON NOMINATING THOSE WHO ARE BEING TRIED"

Yapıcıoğlu pointed out that the elected municipal council members become practically ineffective when a trustee is appointed, stating that they do not find the trustee practice and the nomination of those who are under trial to be correct, and he noted the following; "With the trustee practice, it is not just the Mayor who is removed from office. All Municipal Council Members, who are elected from different parties, also become unable to perform their duties as municipal council members. We need to sit down and discuss this again in the Council. One of the debated aspects is this: why did you not say anything about their candidacy when these individuals ran for election, but you remove them from office after they are elected Mayor? Now, it appears that at least a significant portion of the investigations regarding these individuals began before the elections, and even cases were opened before the elections. The other side then asks, why did you nominate this person while this case is ongoing? Well, why did you accept their candidacy? The law is clear; if you prevent someone's candidacy while they are being tried, then you are definitely obstructing the freedom to vote and be elected.

One of the fundamental principles is this; no one can be treated as guilty until their guilt is established by a court decision. In other words, it is not possible to conclude that someone will definitely be convicted just because they are being tried. They may be acquitted. Therefore, it is not right to say to someone, 'you are being tried, so you cannot be a candidate.' That would be an even more incorrect application than the current practice. Insisting on nominating individuals who are being tried and may face punishment is also something that needs to be discussed and debated. Of course, that person has the right to be a candidate, but if tension is to be avoided, it may be a better path and method to nominate individuals who are not under trial in this regard. Of course, we are not in a position to make decisions on their behalf. This is their choice, but the result is that this creates tension. We must avoid tension and violence. We need to resolve our problems through discussion."
