In the Bilge Site case, where 105 people lost their lives in the earthquakes on February 6, public officials appeared before the judge for the second time. The Bilge Site, located in Osmaniye, was also destroyed in the February 6 earthquakes centered in Kahramanmaraş. 105 people lost their lives in the site, which turned into a pile of rubble, and 6 others were injured.
In the hearing at the Osmaniye 1st Heavy Penal Court, public officials appeared before the judge for the second time today. Some of the public officials being tried without detention and some of the other detained defendants were present via SEGBİS, while others were present in the courtroom. The public officials who were not detained claimed that they were not guilty. The complainants and their lawyers stated that they were complaining about the defendants.
The court panel decided to continue the detention of the technical experts Ayhan Gedik and Haluk Koç, who are being tried for "causing death and injury by negligence"; it also decided to continue the detention of MHP's former Osmaniye Mayor Kadir Kara and former municipal employee Ayşe Argun. The court decided to release the contractors of the building, Mustafa İpek and Faruk Pilge. After the decision, Kara and Argun were arrested and sent to prison.
"THE TRIAL IS PROCEEDING WITHOUT ANY ISSUES OR ERRORS"
After the court, one of the complainants' lawyers, Koray Atmaca, made the following statements:
"In the case regarding the citizens who lost their lives in the Bilge apartment due to the Kahramanmaraş earthquake that occurred on February 6, 2023, the prosecution's opinion led to the arrest of the then-current mayor Kadir Kara and the zoning director Ayşe Argun, the release of two defendants, and the continuation of the detention of the other defendants. The opinion was announced in favor of punishment.
As the representatives of the complainant side, and as the defense attorney for the defendants, we requested time to make statements against the essence and the opinion, as both sides wanted time. According to the provisions of our criminal procedure law, the representatives of both sides were given time to present their final defenses regarding the essence and to make statements regarding the prosecution's opinion.
During this period, both sides will complete their defenses, and on the next session, which is on December 18, 2024, the court will announce its decision. The current stage of the trial is as follows. On December 18, 2024, it will be revealed whether a sentence will be given in accordance with the opinion and whether the opinion will be followed. The trial is proceeding smoothly and without errors, and we believe that the rights of the people we represent will not be neglected. We have faith that justice will prevail."
"JUSTICE WILL BE SERVED"
Defne Güngör, a complainant who lost her parents in the earthquake, said:
"Today, our hearing was held again, Kadir Kara, the former mayor, and Ayşe Argun were arrested. It was decided to continue the detention of Ayhan Gedik, and Haluk Koç's detention was also continued, while the main contractor Mustafa İpek is being tried without detention. Faruk Pilge, who is already the contractor of the Bilge Apartment, has been released. We are saddened by this. There is no such thing as primary fault or release fault in the construction of this building; they are all at fault. Because of their faults, 105 people lost their lives, and six were rescued injured. The building was completely destroyed. We will demand the detention of everyone who is at fault in the upcoming sessions; we will not let this go. Hopefully, justice will be served. Those who lost their lives will rest in peace where they have gone."
"A LITTLE WATER WAS SPRINKLED ON OUR HEARTS"
Mustafa Bakır, who lost his children, wife, and relatives in the building, said: "Today, the former mayor Kadir Kara was arrested in the Bilge Site case. A little water was sprinkled on our hearts. I hope this continues. We are doing our best to ensure that all the guilty are punished. I lost my children, my wife, and my relatives in that building. It shouldn't have been this simple. They have shown us that it wouldn't be. I hope they do not shake our trust in justice. We will continue this struggle until the end. I hope the outcome will be good for everyone. But we will follow this case until the end. We will try to do more than our best."
