In the fatal accident at the pedestrian crossing in Adana, the driver was released due to health issues.

On September 27, a fatal accident occurred in the Serinevler neighborhood of the Yüreğir district in Adana. Cennet Yalçın (68) wanted to cross the road from the İlim Boulevard after leaving Yüreğir State Hospital, where she had come for treatment. Approaching the median, Yalçın was struck by a car with the license plate 01 DAF 53, driven by Mehmet Taşkın (73), and was thrown onto the road. Yalçın, who was seriously injured in the accident, passed away in the hospital despite all interventions.

"ACTED WITH INTENT"

A lawsuit was filed against the arrested driver Mehmet Taşkın by the Adana 18th Criminal Court of First Instance for the crime of "causing death by negligence," seeking up to 6 years in prison. In the second hearing of the case, both the defendant and the plaintiff's lawyer were present.

The plaintiff's lawyer Atilla Karataş stated that the defendant saw the victim and did not take precautions, saying, "The defendant acted with possible intent. We request punishment for conscious negligence and the continuation of his detention."

"MY ILLNESSES INCREASED AFTER THE ACCIDENT"

Defendant Mehmet Taşkın, in his defense, expressed that his illnesses increased after the accident, stating, "I was already a sick person due to my age before the accident, but after the accident, my complaints such as back pain, knee pain, and my legs not holding up increased. I went to the hospital 8 times within 2 months. My legs and back do not hold up. On my way here, 3 people forced me onto the bus. As you can see here, I can barely stand. My wife is bedridden, and there is no one else to take care of her but me. I request my release so that my wife does not suffer more." he said.

"HE SPENT HIS DETENTION PERIOD IN THE HOSPITAL"

The defendant's lawyer stated that his client had to drive because he was not fulfilling his responsibility to take care of his children. The lawyer noted that the location of the incident later became a pedestrian crossing, saying, "The municipality has not yet cut the median for the pedestrian crossing, and such an unfortunate event occurred because the conditions for a pedestrian crossing were not met. He is 73 years old and a sick person. After the last hearing, my client was taken to the hospital 3 times. In fact, he was in the hospital the day before this hearing as well. He spent his entire detention period in the hospital. The prison administration referred him to the health board to determine whether he could stay in prison conditions. We anticipate that the report from the Istanbul Forensic Medicine Institution will also address these issues. We request that my client be tried for 'causing death by unconscious negligence' and that his release be considered due to his age and health problems." he stated.

HE WAS RELEASED

The presiding judge, noting that the report from the Forensic Medicine Institution had not yet arrived, decided to release defendant Mehmet Taşkın, considering his status, evidence circumstances, the illnesses he suffers due to his age, and the absence of suspicion of flight or evidence tampering.
