The Financial Crimes Investigation Board announced that prosecutors have been granted the authority to seize assets in cases of qualified fraud, theft, and credit card crimes without obtaining a report.

The Financial Crimes Investigation Board (MASAK) announced that prosecutors have been granted the authority to seize assets without obtaining a report from MASAK or other relevant institutions only in cases of qualified fraud, theft, and misuse of bank/credit cards.

AUTHORITY TO SEIZE WITHOUT "REPORT" CONDITION FOR PROSECUTORS

An explanation was made regarding the claims in the written and visual media recently stating that "prosecutors will be granted the authority to seize without seeking a report" on MASAK's website.

In this regard, the statement highlighted a draft prepared by the Ministry of Justice, taking into account the views of relevant public administrations, primarily MASAK, and included the following expressions:

THE AIM IS TO PREVENT QUALIFIED FRAUD AND THEFT

"In cases of qualified fraud, qualified theft, and misuse of bank/credit cards, prosecutors are granted the authority to seize assets without obtaining a report from our Presidency or other relevant institutions. The main purpose of such a regulation is to ensure a rapid intervention to prevent the escape of the money involved in crimes, especially in cases of qualified fraud, qualified theft, and misuse of bank/credit cards committed via the internet, from the financial system. The regulation anticipates that the seized funds will be paid to the victims as soon as possible. It is important not to give credence to claims outside of this. Neither our Presidency nor the Ministry of Justice includes any issues that could lead to arbitrary treatment of citizens' property rights in the regulations made."
