A teacher named Banu Kaya, who was serving in Ordu, caused the death of a 7-year-old student when she accidentally hit him with her car while entering the schoolyard on the first day of school. The court decided to release Kaya and imposed a travel ban on her.

In the trial regarding the death of a 7-year-old student in a traffic accident in the schoolyard of the Altınordu district of Ordu, the teacher who was sentenced to 4 years, 5 months, and 10 days in prison was released following an appeal against the detention order.

In the hearing held on October 31, the Ordu 5th Criminal Court of First Instance decided to continue the detention of the defendant Banu Kaya (46), who was sentenced to 4 years, 5 months, and 10 days in prison for the crime of "causing death by conscious negligence." Following this, the defendant's lawyer and the prosecutor separately submitted petitions to appeal the detention to the Ordu 1st Heavy Criminal Court. Evaluating the request, the court decided to release Kaya, taking into account the possibility of a change in the nature and qualification of the crime attributed to the defendant and the time spent in detention, and imposed a travel ban on her.

Reacting to the release request, father Yakup Arslan said, "My little daughter Miray Arslan started the first grade at Gazi Primary School on September 2, 2024, with great excitement and joy. The joy of our child and our family lasted very shortly. We received our child back from the school we sent her to for education with her funeral. The fact that a teacher working at the same school caused our child's death has deepened our pain. It is proven by the forensic report that the teacher who caused our child's death is primarily and fully at fault. A case has been opened against the defendant in the Ordu 5th Criminal Court of First Instance, and despite the evidence suggesting that the defendant likely acted with intent, all requests from our lawyers regarding this were rejected, and the defendant was sentenced to four years, five months, and ten days in prison for causing death by negligence, and it was decided to continue her detention. Although witnesses in the case stated that the teacher who killed our child had previously been warned for entering the schoolyard uncontrollably with her vehicle, this situation was also not taken into account by the court," he said.

BACKGROUND OF THE INCIDENT

On September 2, while teacher Banu Kaya, who was working at Gazi Primary and Secondary School in the Saray neighborhood, was entering the yard with her car, she hit student Miray Arslan, who was coming to school as part of the adaptation week. Despite the intervention at Ordu Education and Research Hospital, where the severely injured child was taken by 112 Emergency Health teams, she could not be saved.

In the fourth hearing held at the Ordu 5th Criminal Court of First Instance, the defendant was sentenced to 4 years, 5 months, and 10 days in prison for the crime of "causing death by conscious negligence," and it was decided to continue her detention. The court also decided to ban Kaya from using her driver's license for 2 years due to her behavior contrary to the obligation of care required by traffic regulations.
