The appeal against the release decision of Melek İpek, who killed her husband Ramazan İpek in Antalya, was unanimously rejected by the Court of Cassation. Thus, İpek's release decision has become final. Melek İpek had killed her husband Ramazan İpek with a shotgun, claiming that he had tortured her.
In Antalya, in the Döşemealtı district, Melek İpek (31), who shot and killed her 12-year-old husband Ramazan İpek (36) with a shotgun on January 7, 2021, on the grounds that he had tortured her, was arrested by the court; during the third hearing held at the Antalya 3rd High Criminal Court, it was decided to release İpek based on the ruling that 'if the exceeding of the limits of legitimate defense arises from an understandable excitement, fear, and panic, the perpetrator shall not be punished.' İpek was released 108 days later.
RELEASE DECISION
The objection to the release decision of the Antalya 3rd High Criminal Court was reviewed by the 1st Criminal Chamber of the Antalya Regional Court of Appeal. The Criminal Chamber, which ruled to reject the appeal on its merits separately, found the decision of the first-instance court to be in accordance with the law.
The decision taken to the Court of Cassation 1st Criminal Chamber ruled unanimously to reject the appeal requests of the Regional Court of Appeal Public Prosecutor, contrary to the Notification, in accordance with Article 298/1 of Law No. 5271. Melek İpek's lawyer Ahmet Onaran stated that they have the file of the decision given by the Court of Cassation and that the decision has become final.
