The lawyers of former HDP Co-Chair Selahattin Demirtaş had filed a release application before the European Court of Human Rights (ECHR) decision becomes final on October 8. Demirtaş's lawyer, Mahsuni Karaman, stated that if the government does not appeal, the ECHR decision will become final and will be binding for the release. According to claims circulating in the corridors, the government will not appeal the decision, and Demirtaş will be released on Wednesday.
Lawyers of the former co-chair of the Peoples' Democratic Party (HDP), Selahattin Demirtaş, who is detained in Edirne F-Type Prison, had applied to the appellate court for his release before the date of October 8, when the European Court of Human Rights (ECHR) violation decision will become final.
LAWYER KARAMAN: OCTOBER 8 IS CRITICAL
Mahsuni Karaman, the lawyer of former HDP co-chair Selahattin Demirtaş, published a statement on the social media platform X titled "The litmus test of the process: the date of October 8 and Demirtaş." Karaman stated that October 8 is critical for Demirtaş's legal process and possible release.
Lawyer Karaman reminded that the European Court of Human Rights (ECHR) has issued three decisions for Demirtaş's release so far, but the necessary actions have not been taken. He stated that these decisions are "the ECHR Chamber decision dated November 20, 2018, the ECHR Grand Chamber decision dated December 22, 2020, and the ECHR Chamber decision dated July 8, 2025."
"CALLS FOR DEMİRTAŞ'S RELEASE ARE BEING MADE"
Mahsuni Karaman continued: "The ECHR Grand Chamber decision dated December 22, 2020, is on the ongoing agenda of the Committee of Ministers of the Council of Europe, and calls for the execution of the decision and the release of Mr. Demirtaş are being made in meetings held periodically."
LISTED THE REASONS FOR THE COURT'S REJECTION
Karaman stated that their application for release after the ECHR decision dated July 8, 2025, was rejected by the Ankara 22nd Heavy Criminal Court, and he listed the court's reasons for rejection as follows: "1) The decision has not yet become final, 2) The decision relates to Demirtaş's detention on September 20, 2019, whereas Demirtaş is no longer detained on suspicion of a crime, but is detained due to a conviction. The parties can appeal the ECHR Chamber decision to the Grand Chamber within three months. The appeal is first examined by a panel of five people called 'Panel,' and if the appeal is found serious, the application is sent to the Grand Chamber. If the Panel does not find the appeal worthy of being sent to the Grand Chamber in its preliminary examination, the Chamber decision will become final."
"WE HAVE A STRONG EXPECTATION FOR RELEASE"
If the government does not appeal, Karaman stated that the ECHR decision regarding Demirtaş will become final on October 8, and he said, "The Appellate Court should immediately review the file and release Mr. Demirtaş and his friends as a matter of law."
ALLEGATION SHAKING THE LOBBIES: DEMİRTAŞ WILL BE RELEASED

MHP'S YILDIZ: OF COURSE, SOME THINGS NEED TO BE DONE
Feti Yıldız, Deputy Chairman of the Nationalist Movement Party (MHP) and Istanbul MP, made a striking statement regarding the expectation of release for Selahattin Demirtaş, the former co-chair of the HDP, who is detained in Edirne Prison.
Yıldız, in a statement to CNN Türk regarding the issue, said, "I do not know the case. What I know are the decisions of the European Court of Human Rights. The decisions of the European Court of Human Rights are directly related to our constitution. Article 90 of our constitution states that 'it must comply with international agreements that have been duly made.' So, while Article 90 of the Constitution stands there, I think some things need to be done."
