In Bursa, accountant Halil Kağan Oğuz killed his boss Mustafa Ekşi by cutting his throat and took checks, promissory notes, and gold. The court sentenced him to aggravated life imprisonment for 'Intentional killing' and 10 years in prison for 'Robbery'. The accountant Halil Kağan Oğuz (32), who killed his boss Mustafa Ekşi (41) by cutting his throat in Bursa and took the checks, promissory notes and gold, was sentenced to aggravated life imprisonment for 'Intentional murder' and 10 years in prison for 'Robbery'. It was reported that Ekşi hired Oğuz 10 months before the incident at the request of his father İ. O., who came to him saying his son was not working anywhere and asked for a job, and that he took out private health insurance for both himself and the killer 6 months before the murder.

The incident occurred on July 6, 2023, next to the Kent Meydanı parking lot in the Osmangazi district. Mustafa Ekşi, who sold auto spare parts and also bought and sold cars, was attacked by his accountant Halil Kağan Oğuz in his car with license plate 16 KM 015. Oğuz, who was sitting in the back seat, cut Ekşi's throat and stabbed him in the back twice, killing him. Oğuz took the checks, promissory notes and valuables from the car and went to his girlfriend's house in Mudanya. Later, Halil Kağan Oğuz went to his friend S. Ş., an auto mechanic, left the checks, promissory notes and items, and surrendered to the police 1 day after the murder. After his statement, the suspect was taken to court and arrested.

HE TOOK THE CHECKS AND PROMISSORY NOTES BECAUSE HE PANICKED

Halil Kağan Oğuz, who was prosecuted for 'Intentional murder' with a demand for aggravated life imprisonment, confessed his crime and said he was regretful and sorry. Describing the day of the incident, Oğuz said, "We came to Kent Meydanı in my boss's car. During the trip, Mustafa took out the checks we were having trouble collecting and started calculating. Since I was dealing with the promissory notes in the company, he turned to me angrily and started shouting, 'Why did we sell these cars?' Then he told me to get out of the car. I got out. After a while, when I got back in, he asked me to sit in the back seat. Mustafa, who has anger issues, then threatened me by saying 'I'll kill you' and pointed the gun he kept in a hidden compartment of the car, so I took the knife that was on the floor of the car and stabbed him in the right shoulder. When I saw blood coming from his throat, I realized the knife had hit his neck. Then I took the checks, promissory notes, valuables and the mobile phone from the car so they wouldn't be left behind. I think I did this because I was in a panic. After leaving the scene, I took a taxi, first went to my girlfriend's house and changed my bloody clothes. Then I went to the workplace of a friend of mine who has an auto repair shop and gave the checks, promissory notes and gold to my friend. Then I surrendered to the police," he said.

38 MILLION LIRA WORTH OF CHECKS MISSING

The nature of the crime changed when Mustafa Ekşi's wife Melike Ekşi stated that she could only recover 15 promissory notes worth 5 million lira and valuables, and that 90 checks worth 38 million lira were still missing. After the claims, evidence and witness statements regarding the missing checks, Oğuz was charged with 'Armed qualified robbery' and 'Qualified intentional murder'. In the hearing, the prosecutor who gave his opinion on the merits demanded that the defendant be sentenced to aggravated life imprisonment for 'Qualified intentional murder' and 10 to 15 years in prison for 'Armed qualified robbery'.

'THE DEFENDANT AND HIS RELATIVES HAVE BECOME A SOURCE OF UNJUST ENRICHMENT'

The final hearing of the case was held at the Bursa 4th Heavy Penal Court. In the hearing, Melike Ekşi's lawyer Figen Şahin Sarıbal said, "In the concrete incident where the defendants agreed to commit the crime of robbery in advance using force and violence and, if necessary, weapons, the fact that the defendant's father İ. O. had the checks, which are bloody evidence obtained from his son's murder, queried at banks under the name of 'intelligence' shows that he was aware of the commission of the crime or at least its consequences, and that he intended to benefit from the proceeds of the robbery. The fact that the defendant's father was in possession of the victim's check on the day and time his son killed the victim and had it inquired about at the bank through third parties indicates the existence of an organization aimed at completing the robbery, beyond the crimes of participation in crime or destroying/concealing evidence. The fact that the defendant Halil Kağan Oğuz, after killing the victim, seized large amounts of cash, gold and checks, including the victim's mobile phone, has not only caused material and moral devastation to the victim's family, but has also become a source of unjust enrichment for the defendant and his close circle. The claims and determinations in the file reveal that the defendant's family and his girlfriend B. B. achieved a level of financial prosperity in the period after the incident that cannot be explained by their legitimate income sources, purchasing latest model luxury vehicles and opening new workplaces," she said.

'WE ARE FACED WITH A MERCILESS EXECUTION ORGANIZATION'

Lawyer Sarıbal said, "The 'bloody wealth' obtained by the defendant by killing the victim is being systematically laundered by his relatives. The fact that the defendant's girlfriend B. B., under the defendant's direction, created fake vehicle purchase and sale messages is part of the cold-blooded planning in the process of committing the crime. Moreover, the payment order found in your court, allegedly written by the defendant and sent to a bank, was also delivered to the participant plaintiff Melike Ekşi by B. B. In the case at hand, the defendant's action appears to be a planned and organized crime network based on depriving the victim of his right to life and seizing his assets. When evaluated as a whole: the defendant's father having the checks queried, his girlfriend's assistance before and after the crime, and the defendant having previously vaporized over 1 million TL of the victim's money; we are faced not with an isolated murder, but with a merciless execution organization aimed at economic gain. Therefore, it is a legal necessity to impose the maximum penalty on the defendant, without any discretionary reduction, for both the crime of qualified intentional murder and the crime of armed robbery, in accordance with the gravity of the act. We request a decision in line with the opinion," he stated.

'THE INCIDENT DEVELOPED BECAUSE THE VICTIM SAID HE WOULD KILL ME, I AM SORRY'

The defendant Halil Kağan Oğuz, stating that he did not act with the intent of robbery, said, "The incident developed suddenly. I committed such an act because the victim cursed at me during the incident and said he would kill me. I am very sorry for what I did."

NO REDUCTION APPLIED

The court panel, announcing its decision, did not apply 'self-defense', 'unjust provocation' or 'discretionary reduction' to the sentence of the detained defendant, who was given aggravated life imprisonment for 'Intentional murder' and 10 years in prison for 'Robbery'.

On the other hand, it was learned that Mustafa Ekşi hired Halil Kağan Oğuz around 10 months before the incident at the request of his father İ. O., who came to him saying his son was not working anywhere and asked for a job, and that he took out private health insurance for both himself and the killer 6 months before the murder.

While his son was imprisoned, the investigation into İ. O., who had the 750 thousand lira missing check belonging to Mustafa Ekşi questioned by a person he does business with in the İnegöl district, continues.
