Fatima Zehra Kınık Demir, the daughter of former Red Crescent President Kerem Kınık, was found to be primarily at fault in the expert report prepared by the Traffic Specialization Department of the Forensic Medicine Institution, in the case she is being tried for causing the death of one person and injuring three others. Kınık had previously been found to be 100% at fault in one of the two earlier expert reports, and primarily at fault in the other.
Former Red Crescent President Kerem Kınık's daughter Zehra Kınık Demir collided with a motorcycle driven by Yavuz Selim Öztürk in Beykoz Kavacık last July while driving her car. In the incident, 17-year-old Batın Barlasçeki, who was sitting on the back of the motorcycle, fell and hit his head on concrete barriers, resulting in his death. Öztürk, who was riding the motorcycle, and two pedestrians who were struck by the motorcycle were also injured. After the accident, in which one person died and three were injured, Fatıma Zehra Kınık was detained for one day and then released under judicial control. Kınık later applied for the lifting of the travel ban.
EXPERT FOUND 100% AT FAULT
In the case where Zehra Kınık Demir is being prosecuted for "causing death and injury by negligence" with a prison sentence of 2 to 15 years, it was stated in the expert report prepared regarding the accident, at the request of Barlasçeki's family's lawyer Uysal Uğurlu, that she caused the accident by not waiting for other vehicles to pass while entering the main road and was found to be 100% at fault. Later, at the court's request, a second expert report was prepared by two specialists, which stated that Zehra Kınık was primarily at fault in the occurrence of the accident. Finally, the file was sent to the Forensic Medicine Institution Traffic Specialization Department.
FORENSIC MEDICINE INSTITUTION ALSO SAID "ZEHRA KINIK IS PRIMARILY AT FAULT"
The expert report prepared by the Forensic Medicine Institution Traffic Specialization Department was completed and entered into the case file. In the report, Zehra Kınık Demir was found to be primarily at fault in the accident. The report stated, "The defendant driver Fatıma Zehra Kınık Demir, while driving the car under her control, should have stopped at the 'Stop' traffic sign located at the intersection and checked the traffic conditions of the vehicles on the one-way two-lane road sufficiently before proceeding. She should have given the right of way to the motorcycle driven by the complainant driver coming from the left side of the intersection and wishing to continue straight. However, she failed to comply with these obligations and collided with the motorcycle driven by the complainant driver, thus acting contrary to her duty of care and attention, making her primarily at fault."
FOUND SECONDARILY AT FAULT
On the other hand, in the report, Barlasçeki, who lost his life in the accident, was found to be secondarily at fault due to riding without a helmet.
