The HSK 1st Department initiated an investigation against the Chief Public Prosecutor of Büyükçekmece, Harun Ayık, in 2015 due to a land sale case located in Çerkezköy. According to Ilker Turak from Ekol Tv, Prosecutor Harun Ayık referred a petition submitted by a complainant named Ahmet Ş. as if it were his own case, despite lacking the authority to do so. Prosecutor Ayık also separated the individuals appearing as complainant and suspect in the petition he received and began to conduct the investigation himself. 'I WILL ISSUE A WARRANT FOR HIS ARREST' HE SAIDAfter the complaint petition submitted by complainant Ahmet Ş., Prosecutor Harun Ayık instructed his clerk to call a person named İsmail D. by phone to summon him to the courthouse for his statement regarding the accusation of 'fraud', stating that if he did not come, he would issue a warrant for his arrest. HE HAD HIM DETAINEDOn October 4, 2017, when İsmail D. came to give his statement, Prosecutor Ayık told him, "There is a complaint against you. You took the man's money and victimized him. Make peace with this man and pay your debt, otherwise they will say you are affiliated with FETÖ, they will say the leader cursed." To this, İsmail D. replied, "There is an ongoing case between us, they are asking for money from me unjustly." Upon this, Prosecutor Ayık told İsmail D. to go "Wait outside" and called the law enforcement to issue a detention order. Prosecutor Ayık also imposed confidentiality on the case. HE GAVE INSTRUCTIONS FOR A STATEMENT IN ANOTHER CASEThe next day, İsmail D.'s lawyer wanted to obtain information. Prosecutor Harun Ayık said, "There is an allegation of FETÖ in the file. I will already declare it as a lack of jurisdiction. I will send the file to the organized crime bureau." Despite the detention order expiring, Prosecutor Ayık issued instructions for İsmail D. to give a statement in another case under the supervision of police officers assigned to the Counter-Terrorism Branch, despite having issued a judicial control and travel ban decision. HE WAS SENTENCED TO PRISON AND DISMISSEDAfter the incidents, İsmail D. filed a complaint against Prosecutor Harun Ayık. The Judges and Prosecutors Council's First Department initiated an investigation and suspended him. The HSK Second Department granted permission for prosecution. In the trial conducted by the 5th Criminal Chamber of the Court of Cassation as a first instance court, Ayık was sentenced to 3 years and 3 months in prison for the crimes of 'Embezzlement', 'Abuse of rights and authority', and 'Deprivation of liberty by using his position' and was dismissed from his position.
