In the first hearing of the trial regarding the murder, he was sentenced to aggravated life imprisonment for the crime of "intentional murder against a woman." On June 19, 2024, in Esenyurt, Istanbul, a person named Fethi Dağlı strangled Erva Raziye Asar, whom he had called to his home for cleaning, and then dismembered her body into six pieces and disposed of it at a construction site in Beylikdüzü. The first hearing at the Bakırköy 19th Heavy Penal Court was attended by the detained defendant Fethi Dağlı. The victim's mother, complainant Nazik Asar, and father Hasan Asar also attended the hearing.

HE DESCRIBED THE HORRIFIC MURDER IN DETAIL

In his defense, defendant Fethi Dağlı stated, "I was released from prison on supervised probation in 2022. I had been working as a security guard in a site in Beylikdüzü for 3-4 months. I posted an ad in a job finding group on Facebook. I was receiving a commission from this job. I met Erva in this group. I was looking for a woman for house cleaning. I met Erva a month before the incident. I invited her to clean my house. She came three times. Then this incident happened. On the day of the incident, she told me, 'The people I met before you did not treat me well, you are treating me well, I want to marry you.' I told her to go to the hospital and get treatment and I rejected her. She said to me, 'Aren't you a man? I want to be with you of my own free will.' She said things that are unacceptable. I wanted her to leave the house, and she started throwing things at me. Because she started screaming, I covered her mouth with my hand. The scarf slipped around her neck. I tightened the scarf. The victim fell to the ground. Then I went outside. I left her in that condition. I got some dressing materials because I was injured myself," he expressed.

"I PUT THE BODY IN THE FRIDGE WHOLE SO IT WOULDN'T DECAY, THEN I DISMEMBERED IT"

In the continuation of his defense, the defendant stated, "I put the body in the fridge whole so it wouldn't decay. Then I went to work. The body stayed in the fridge for 2 days. I dismembered the body 2 days later to get rid of it. I put it in boxes. I left it in the security booth first with the boxes. The body parts stayed in the boxes for one night. Then I threw them into the elevator shaft. I kept the phone. Erva's aunt called me. 'We learned from the police that she last met with you, her mother is in very bad condition, is she with you?' I couldn't say anything when I said her mother was sick. Her mother also called, and I couldn't say anything to her either. I used Erva's SIM card. Because I was saddened by her mother's illness, I wrote messages as if I were Erva. I even paid the bill. A piece of an arm was found near the construction site. A security friend called me and informed me. I got rid of that too. I threw the arm piece back to where the elevator shaft was. The victim's phone was also in the security booth where I worked, and the police took it from there," he said.

The victim's mother, Nazik Asar, stated in her testimony, "She left the house on the day of the incident saying it was a job interview. She went to this killer's house instead. Then I called her, and she once told me 'I'm far away,' and another time she said 'I'm coming.' But her voice was very hoarse and cold. She was dealing with this killer. Later, I couldn't reach my daughter again. The killer had called my daughter's father later. He said, 'She left, I couldn't stop your daughter.' I am complaining about the defendant who killed my daughter," she said. The victim's father, Hasan Asar, stated, "The defendant messaged my daughter from my daughter's account. At the very beginning of the incident, the defendant had opened an account as a woman. He introduced himself to my daughter as a woman. My daughter left the house on the day of the incident to have a job interview." The public prosecutor, who presented his opinion, requested that the defendant be sentenced to aggravated life imprisonment for the crime of 'intentional murder of a woman.' The defendant replied, "I agree with the opinion."

AGGRAVATED LIFE IMPRISONMENT SENTENCE

After the opinion was presented, the court announced its decision, sentencing the defendant Fethi Dağlı to aggravated life imprisonment for the crime of 'intentional murder of a woman.'

FROM THE INDICTMENT

The indictment prepared by the Bakırköy Chief Public Prosecutor's Office described the incident that occurred on June 19, 2024, in Esenyurt, Istanbul. The indictment noted that Erva Raziye Asar left home on the day of the incident saying she was going for a job interview, and after she could not be reached, a complaint was filed. Investigations revealed that the victim Asar entered the house of the defendant Fethi Dağlı in Hürriyet Neighborhood but did not exit. Following the findings, it was determined that Fethi Dağlı was visited at his home, where he confessed, "Erva Raziye Asar wanted to have sexual relations with me. I did not accept. She said to me, 'I will say that I am being raped.' So I strangled her with a rope. I took her to the toilet of the house. After I was sure she was dead, I dismembered her with a bread knife. I put her in the freezer at home. After waiting for 1-2 days, I took the dismembered body out in boxes and bags, took a taxi, and threw it at a construction site." On July 12, during the location identification process, it was determined that human body parts were floating in the elevator shaft within the construction site. Additionally, it was stated in the indictment that after a security guard, who was a friend of Fethi Dağlı, said, 'Citizens around said there is a severed human arm,' the defendant replied, 'This is not our area, don't interfere, I will handle it.' It was also expressed in the indictment that Fethi Dağlı took the victim Erva Raziye Asar's phone line and inserted it into his own phone, messaging her relatives as if she were still alive. Furthermore, the cause of death of Erva Raziye Asar was stated by the Forensic Medicine Institution to be 'asphyxia due to ligature strangulation.' The indictment indicated that Erva Raziye Asar went to the defendant Fethi Dağlı's house, what happened between them is unknown, and the defendant strangled the victim with a rope that could not be seized, then dismembered the body into eight pieces and stored it in the deep freezer. It was noted that the defendant later wrapped the body parts in bags and threw them into the water-filled elevator shaft near the place where he worked as a security guard, and that the parts, which eventually surfaced, were likely carried out of the construction site by street animals and seen by unidentified individuals passing by the scene. It was also stated in the indictment that a security guard named Oktay, who saw the defendant as a superior, informed him of the situation, but the defendant prevented Oktay from intervening by saying, 'I will handle it.'

In the prepared indictment, it was requested that Fethi Dağlı be sentenced to aggravated life imprisonment for the crime of 'deliberately killing with monstrous feelings and inflicting torture.'
